Zoning Changes for Business Licenses

This bill allows state officials to revoke or suspend business licenses based on local zoning violations and requires property deeds to include current zoning classifications.

What This Bill Does

  • Allows the executive officer of a state department or agency to revoke or suspend a business license upon receiving written notice from a local zoning authority stating that the business is not in compliance with local zoning laws.
  • Requires the revocation or suspension notice to be mailed to the business owner, who can appeal this decision under the Uniform Administrative Procedures Act.
  • Sets up a process for reinstating revoked licenses after compliance with zoning laws is proven and may include fees based on whether the business was initially compliant.
  • Adds a requirement that property deeds must show the current zoning classification of the land at the time of recording.

Who It Names or Affects

  • Business owners who do not follow local zoning rules
  • State officials responsible for issuing and managing business licenses
  • Local government zoning authorities
  • People buying or selling real estate

  • It's unclear how often local zoning classifications change and whether this will cause confusion in property transactions.
