Plain English Breakdown

The bill summary text does not mention a requirement for siblings to share at least one biological parent, but this was later amended. The official digest text confirms that the amendment removed this requirement.

Adoption Simplification Act

This bill allows families adopting multiple sibling children at once to file one adoption petition and pay only one filing fee unless the court decides otherwise.

What This Bill Does

  • Allows people who want to adopt more than one child at the same time, if those children are siblings with a common biological parent, to include all of them in one adoption request.
  • Requires courts to charge just one filing fee for such combined adoption requests.

Who It Names or Affects

  • Families who want to adopt more than one child at once, especially if those children are siblings with a common biological parent.
  • Courts that handle adoption cases in Tennessee.

Terms To Know

Petition
A formal request made to a court or other authority for the granting of some right or remedy.
Filing fee
The cost paid when submitting documents to a government office, such as a court clerk's office.

Limits and Unknowns

  • The bill applies only if the children being adopted are siblings with at least one common biological parent.
  • It does not specify what happens if the court decides separate petitions are needed for the best interest of the children.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to HB1180

Plain English: This amendment allows parents adopting multiple sibling children at once to file one adoption petition and pay only one filing fee.

  • Parents can now include all sibling children in one adoption petition if they are adopting more than one child together.
  • The court may require separate petitions for siblings only if it is determined to be in the best interest of the children.
  • A single filing fee will cover multiple sibling adoptions under this new process.
  • It's unclear how courts will determine when separate petitions are necessary for the best interests of the children.
