Plain English Breakdown

The candidate explanation included details about extradition that were not fully supported by the official source material. The bill text does mention extradition but lacks specific timing requirements for initiating it.

Placing Defendants on Fugitive Lists for Failure to Appear

This act requires defendants who miss certain felony and misdemeanor court dates to be listed as fugitives and mandates timely actions by judicial officials, clerks, and entering agencies.

What This Bill Does

  • If a defendant misses a court date for a felony or a Class A or B violent or sexual misdemeanor, they must be added to state or federal fugitive lists like the National Crime Information Center.
  • Judicial officials must sign bench warrants or capias by the end of business on the day of the missed appearance. The clerk then sends these documents to entering agencies by the next business day's end.
  • Entering agencies must add the warrant information to state or federal fugitive lists within three business days after receiving it from the court.

Who It Names or Affects

  • Defendants who miss certain felony and misdemeanor court dates
  • Judicial officials who issue bench warrants or capias
  • Clerks responsible for sending out legal documents
  • Entering agencies that manage state and federal fugitive lists

Terms To Know

Bench warrant
A court order to arrest someone who has missed a court date.
Capias
An official command to take someone into custody, often used when someone misses a court appearance.

Limits and Unknowns

  • The bill does not specify the exact consequences for failing to follow these new requirements.
  • It is unclear how this will affect defendants who miss less serious misdemeanor court dates.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to HB1256

Plain English: The amendment changes how Tennessee handles bench warrants and capias for certain criminal cases by adding requirements for placing defendants on state or federal fugitive lists and setting deadlines for judicial actions.

  • If a defendant fails to appear in court for specific crimes, they must be added to the National Crime Information Center as a fugitive from justice.
  • Judicial officials have one business day after a failure to appear to sign bench warrants or capias, and clerks must transmit these documents to entering agencies within another business day.
  • Sureties are not responsible for bail if defendants aren't listed on state or federal databases within three business days of receiving the warrant or capias.
  • The amendment text does not specify all details about how sureties will be notified or compensated, which may need further clarification.

  • Judicial officials are required to sign bench warrants or capias within one business day of the failure to appear and transmit them to entering agencies immediately thereafter.
  • Sureties are not responsible if defendants aren't placed on state or federal lists within three business days after receiving the warrant or capias.

  • The amendment text does not specify all possible scenarios and exceptions, which may leave some questions unanswered about its full impact.
