ON MARCH 9, 2026, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1731, AS AMENDED.

AMENDMENT #1 excludes from the definition of those who desecrate a place of burial
an employee of the department of environment and conservation's division of archaeology in the ordinary course of the employee's duties
and
persons otherwise authorized by law to remove objects
from a place of burial.

AN ACT to amend Tennessee Code Annotated, Title 39
and Title 46, relative to places of burial.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 39-17-311, is amended by adding
the following as a new subsection:
(c) As used in this section, "desecrate" includes, but is not limited to, the removal
of objects from a place of burial by a person other than a family member of the deceased
or an authorized representative of the cemetery.
SECTION 2. This act takes effect July 1, 2026, the public welfare requiring it.
