Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to HB2592

Plain English: The amendment adds new rules for expanding the governing boards of electric utilities based on customer numbers and geographic areas.

  • Defines key terms related to electric utilities, including 'home county,' 'outside locality,' and 'utility board.'
  • Requires an electric utility serving between 3,500 and 130,000 customers in its home county to add one voting member to the utility board if requested by the home county.
  • For utilities serving more than 130,000 customers in their home county, two additional voting members must be added to the board upon request from the home county.
  • The amendment text is incomplete and does not provide full details on all aspects of the proposed changes.
  • Further sections that would detail how these new board members are appointed and their terms are cut off, making it unclear about specific implementation details.
Amendment 2-0 to HB2592

Plain English: The amendment adds new rules for expanding utility boards when electric utilities serve customers outside their home municipality within the same county or in other counties.

  • Defines an 'electric utility' as a public utility owned by a large municipality and sets conditions under which it must expand its board to include representatives from areas served outside of its corporate limits.
  • Specifies that if an electric utility serves between 3,500 and 130,000 customers in the home county but outside its municipal boundaries, the home municipality must add one voting member to the utility board appointed by a city or town with the largest number of served customers.
  • If more than 130,000 customers are served, another additional voting member is required on the utility board from a city or town with the second-largest customer base.
  • The amendment text was truncated and does not provide complete details for all sections, making it difficult to summarize fully.
  • Further specifics about how these new members are appointed and their roles are not clearly defined in this excerpt.
Amendment 3-0 to HB2592

Plain English: The amendment changes references to specific sections related to electric cooperatives in Tennessee's utility laws and removes some outdated or redundant provisions.

  • Removes 'the provisions of this section with respect to electric cooperatives' from Section 6-51-111(a) and replaces it with a reference to Title 65, Chapter 34.
  • Deletes Tennessee Code Annotated, Section 6-51-112 entirely.
  • Modifies references in several sections of the code to remove mentions of deleted or irrelevant provisions related to electric cooperatives.
  • Amends various sections to clarify that certain rights and limitations apply according to applicable law rather than specific repealed sections.
  • The amendment text does not provide detailed explanations for each change, making it difficult to understand the full implications of some modifications without additional context.
Amendment 1-0 to SB2102

Plain English: The amendment adds new provisions to Tennessee Code Annotated that require certain electric utilities serving outside localities to expand their board membership to include representatives from those localities.

  • Defines key terms such as 'electric utility', 'municipality', and 'outside locality'.
  • Requires an electric utility providing services to at least 3,500 retail customers in an outside locality to add one voting member to its board from the county where that locality is located.
  • Specifies how the chief executive officer of the outside county appoints a new board member with approval from the governing legislative body of the county.
  • The amendment does not specify all details about the process for removing or replacing appointed board members beyond initial appointment procedures.
