Official Summary Text

Present law requires a certificate of need prior to establishing or initiating operation of a nonresidential substitution-based treatment center for opiate addiction.

An applicant for a certificate of need for such a treatment center must notify the county mayor of the county in which the facility is proposed to be located and the state senator and representative for the area within 10 days after filing the application
with the health facilities commission (“
commission”
).

An exemption applies in counties
without an actively licensed acute care hospital; however, that exemption does not apply to these treatment centers.
Additionally, a
certificate of need is not required for a licensed hospital to operate such a treatment center if it is located on the same campus as the operating hospital.

This bill
removes nonresidential substitution-based treatment centers for opiate addiction

from the list of institutions subject to
these requirements and notice procedures
. It removes the requirement
these centers to obtain a certificate of need prior to initiation and repeal

the specific notification requirements for such applications.

ADMINISTRATIVE FEES AND REPORTING

AN ACT to amend Tennessee Code Annotated, Title 68,
Chapter 11 and Chapter 985 of the Public Acts of
2024, relative to certificate of need.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 68-11-1602(10)(A)(ix), is amended
by deleting the subdivision.
SECTION 2. Tennessee Code Annotated, Section 68-11-1602(16), is amended by
deleting the subdivision.
SECTION 3. Tennessee Code Annotated, Section 68-11-1607, is amended by deleting
subdivisions (a)(3)(I), (c)(9), and (x)(2)(D) and subsection (p).
SECTION 4. Tennessee Code Annotated, Section 68-11-1614(b), is amended by
deleting the subsection.
SECTION 5. Tennessee Code Annotated, Section 68-11-1614(c), is amended by
deleting ", mental health and substance abuse services,".
SECTION 6. Tennessee Code Annotated, Section 68-11-1620(c)(12), is amended by
deleting the subdivision.
SECTION 7. This act takes effect July 1, 2026, the public welfare requiring it.
