A BILL TO BE ENTITLED

AN ACT

relating to the applicability of the law governing a grant program

for public improvement projects for unincorporated communities in

certain counties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 388.001, Local Government Code, is

amended to read as follows:

Sec. 388.001. APPLICABILITY. This chapter applies only

to
:

(1)
a county that:

(A)
[
(1)
] has a population of
less
[
not more
]

than 3,000;

(B)
[
(2)
] is adjacent to at least three counties

with populations of less than 10,000; and

(C)
[
(3)
] is located on an international border
;

and

(2) a county:

(A)

that is located on an international border;

and

(B)

in which is partially located a national park

of less than 100,000 acres
.

SECTION 2. This Act takes effect immediately if it receives

a vote of two-thirds of all the members elected to each house, as

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
