H.B. No. 109

AN ACT

relating to the construction, expansion, and operation of certain

inpatient mental health facilities and the designation of

residential treatment facilities for certain juveniles.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 551.007, Health and Safety Code, is

amended by adding Subsection (c) to read as follows:

(c)

If the legislature appropriates money to the commission

for the purpose of the construction, expansion, or operation of

certain inpatient mental health facilities under authority

conferred by Sections 2155.144(b-2) and 2166.251, Government Code,

the commission may award the money as a one-time grant directly to

an entity for that purpose.

SECTION 2. Section 554.001(a), Health and Safety Code, is

amended to read as follows:

(a) The department shall
designate state facilities for
use

[
the Waco Center for Youth
] as [
a
] residential treatment
facilities

[
facility
] for emotionally disturbed juveniles who:

(1) have been admitted under Subtitle C to a facility

of the department; or

(2) are under the managing conservatorship of the

Department of Family and Protective Services and have been admitted

under Subtitle C to
a state facility designated by the department

under this section
[
the Waco Center for Youth
].

SECTION 3. Section 554.002, Health and Safety Code, is

amended to read as follows:

Sec. 554.002. SERVICES. (a) The department shall provide

without charge appropriate education services for all clients

residing at
state facilities designated by the department under

Section 554.001
[
the Waco Center for Youth
].

(b) The department shall pay for
the
[
those
] services

described by Subsection (a)
from funds appropriated [
to the center
]

for that purpose.

(c) A client of
a state facility designated by the

department under Section 554.001

the center
] who is not a resident

of the
school district that serves the geographical area in which

the facility is located

Waco Independent School District
] may

receive education services from the
district

Waco Independent

School District
] only with the prior approval of the superintendent

of the district.

SECTION 4. This Act takes effect September 1, 2025.
