A BILL TO BE ENTITLED
AN ACT
relating to the creation of an environmental product declaration
grant program for certain manufacturers of ready-mixed concrete.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 5, Water Code, is amended
by adding Section 5.1245 to read as follows:
Sec.
5.1245.
ENVIRONMENTAL PRODUCT DECLARATION GRANT
PROGRAM FOR CERTAIN MANUFACTURERS OF READY-MIXED CONCRETE. (a) In
this section, "environmental product declaration" means an
independently verified product-specific label that discloses the
environmental impact of a manufactured product based on a life
cycle assessment.
(b)
This section applies only to a manufacturer of
ready-mixed concrete that:
(1)
is a corporation, partnership, sole
proprietorship, or other legal entity formed for the purpose of
making a profit;
(2) is independently owned and operated; and
(3)
has fewer than 100 employees or less than $6
million in annual gross receipts.
(c)
The commission shall establish and administer a grant
program to reimburse manufacturers of ready-mixed concrete
described by Subsection (b) for the cost of accessing an
environmental product declaration database or other software for
generating environmental product declarations for ready-mixed
concrete products.
(d)
As a condition of receiving a grant under this section,
a manufacturer must agree to use environmental product declarations
for the manufacturer's ready-mixed concrete products.
(e)
The commission shall adopt rules to implement the
program established under this section, including rules
establishing:
(1) eligibility criteria for grant applicants;
(2) grant application procedures;
(3)
criteria for evaluating grant applications and
awarding grants;
(4) guidelines related to grant amounts; and
(5)
procedures for monitoring the use of a grant
awarded under this section and ensuring compliance with any
conditions of the grant.
SECTION 2. The Texas Commission on Environmental Quality
shall adopt rules and establish procedures under Section 5.1245,
Water Code, as added by this Act, as soon as practicable after the
effective date of this Act.
SECTION 3. This Act takes effect September 1, 2025.
