A BILL TO BE ENTITLED

AN ACT

relating to public notice of a crematory's compliance history,

rating, and classification.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter C, Chapter 382, Health and Safety

Code, is amended by adding Section 382.070 to read as follows:

Sec.

382.070.

NOTICE OF CREMATORY COMPLIANCE. (a) In this

section, "crematory" has the meaning assigned by Section 711.001.

(b)

The commission shall post on the commission's Internet

website information relating to the compliance with this chapter of

each crematory operating under a permit issued under this chapter,

including the crematory's compliance history and classification

according to commission standards adopted under Sections 5.753 and

5.754, Water Code. The commission must:

(1)

display the information in a manner that is easily

and publicly accessible; and

(2)

update the Internet website with a crematory's

current information not later than:

(A)

the 30th day after the date the commission

changes a crematory's compliance history or classification; or

(B)

the 30th day after the date the executive

director issues a decision in response to a crematory's appeal of an

updated classification.

(c)

The commission shall develop a template for crematories

to use for displaying the public notice required under Subsection

(d).

(d)

The commission by rule shall require each crematory

operating under a permit issued under this chapter to display in a

conspicuous manner clearly visible to the public a notice that

includes:

(1)

the regulated name and reference number of the

crematory;

(2)

the compliance history and classification of the

crematory;

(3)

instructions for submitting complaints regarding

emissions from the crematory to the commission and for contacting

the closest commission regional office; and

(4)

instructions for accessing the commission's

Internet website for more details on the compliance history and

classification of the crematory.

SECTION 2. (a) Not later than September 1, 2026, the Texas

Commission on Environmental Quality shall adopt rules necessary to

implement Section 382.070, Health and Safety Code, as added by this

Act.

(b) The Texas Commission on Environmental Quality is not

required to post the information required by Section 382.070(b),

Health and Safety Code, as added by this Act, before the commission

adopts the rules required by Section 382.070(d), Health and Safety

Code, as added by this Act.

SECTION 3. This Act takes effect September 1, 2025.
