A BILL TO BE ENTITLED

AN ACT

relating to voting by a voter unable to enter a polling place.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 64.009(a), Election Code, is amended to

read as follows:

(a)
On

If a voter is physically unable to enter the polling

place without personal assistance or likelihood of injuring the

voter's health, on
] the voter's request, an election officer shall

deliver a ballot to the voter at the polling place entrance or curb

if the voter:

(1)

is physically unable to enter the polling place

without personal assistance or likelihood of injuring the voter's

health;

(2)

has legal custody of a child younger than 12 years

of age and entering the polling place would require leaving the

child without adequate supervision; or

(3)

is the primary caretaker of a person who is unable

to care for themselves and entering the polling place would require

leaving the person without adequate supervision
.

SECTION 2. This Act takes effect September 1, 2025.
