A BILL TO BE ENTITLED

AN ACT

relating to the processing of an application for an authorization

to use a standard permit for a rock or concrete crushing facility.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 382.05195, Health and Safety Code, is

amended by adding Subsection (l) to read as follows:

(l)

The commission shall give priority when processing

applications for an authorization to use a standard permit under

this section for a rock or concrete crushing facility to an operator

who the commission determines:

(1)

has previously been authorized to use a standard

permit under this section for a rock or concrete crushing facility;

and

(2)

if the operator of the facility described by

Subdivision (1) did not own the land on which the facility was

located, reclaimed the land disturbed by the facility:

(A)

before the 180th day after the date the

facility ceased operating; or

(B)

according to the terms of any lease agreement

between the operator and the landowner.

SECTION 2. This Act takes effect September 1, 2025.
