A BILL TO BE ENTITLED
AN ACT
relating to the issuance of and fee for a permit for the movement of
oversize and overweight vehicles on certain routes in Hidalgo
County and the use of those fees for the payment of the costs of
constructing and maintaining certain of those routes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 623.363, Transportation Code, is amended
by amending Subsection (a) and adding Subsections (a-1) and (c) to
read as follows:
(a) The commission may authorize a regional mobility
authority to issue permits for the movement of oversize or
overweight vehicles carrying cargo in Hidalgo County on:
(1) [

] U.S. Highway 281 between its intersection
with the Pharr-Reynosa International Bridge and its intersection
with State Highway 336;
(2)

(B)
] State Highway 336 between its intersection
with U.S. Highway 281 and its intersection with Farm-to-Market Road
1016;
(3)
[
(C)
] Farm-to-Market Road 1016 between its
intersection with State Highway 336 and its intersection with
Trinity Road;
(4)
[
(D)
] Trinity Road between its intersection with
Farm-to-Market Road 1016 and its intersection with Farm-to-Market
Road 396;
(5)
[
(E)
] Farm-to-Market Road 396 between its
intersection with Trinity Road and its intersection with the
Anzalduas International Bridge;
(6)
[
(F)
] Farm-to-Market Road 2061 between its
intersection with Farm-to-Market Road 3072 and its intersection
with U.S. Highway 281;

(a-1)
The authority authorized under this section shall pay
from fees collected by the authority under Section 623.364 all
costs to construct and maintain the route designated under
Subsection (a)(9), and any off-system road designated after
September 1, 2025.
(c)
The authority authorized under this section may not
issue a permit under this section for an oversize or overweight
vehicle that is transporting in a cargo tank hazardous material in a
quantity requiring placarding by a regulation issued under the
Hazardous Materials Transportation Act (49 U.S.C. Section 5101 et
seq.).
SECTION 2. Section 623.364(a), Transportation Code, is
amended to read as follows:
(a) The authority may collect a fee for permits issued under
this subchapter. Beginning September 1,
2025

], the maximum
amount of the fee may not exceed
$250

] per trip. On September
1 of each subsequent year, the authority may adjust the maximum fee
amount as necessary to reflect the percentage change during the
preceding year in the Consumer Price Index for All Urban Consumers
(CPI-U), U.S. City Average, published monthly by the United States
Bureau of Labor Statistics or its successor in function.
SECTION 3. (a) Except as provided by Subsection (b) of this
section, this Act takes effect September 1, 2025.
(b) This Act takes effect only if S.B. 2949, 89th
Legislature, Regular Session, 2025, is enacted and becomes law. If
legislation described by this subsection is not enacted or does not
become law, this Act has no effect.
