H.B. No. 2757

AN ACT

relating to a public school policy for establishing age for

purposes of admission into the school for certain children of

foreign military members.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 25.001, Education Code, is amended by

adding Subsection (c-3) to read as follows:

(c-3)

Notwithstanding Subsections (a) and (b), the board of

trustees of a school district may adopt a policy to allow a person

whose parent or guardian is an active-duty member of a foreign

military force stationed in this state to establish the person's

age for purposes of determining eligibility under those subsections

by demonstrating that the person will turn the required age during

the school year for which the person is seeking admission.

SECTION 2. This Act applies beginning with the 2025-2026

school year.

SECTION 3. This Act takes effect immediately if it receives

a vote of two-thirds of all the members elected to each house, as

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
