A BILL TO BE ENTITLED

AN ACT

relating to purchase or other acquisition of personal property by a

political subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 271.003(8), Local Government Code, is

amended to read as follows:

(8) "Personal property" includes appliances,

equipment, facilities, and furnishings, or an interest in personal

property, whether movable or fixed, considered by the governing

body of the governmental agency to be necessary, useful, or

appropriate to one or more purposes of the governmental agency. The

term includes all materials
, consultation, assistance,
and labor

incident to the installation
or use
of that personal property. The

term includes electricity and cloud computing services. The term

does not include real property.

SECTION 2. Section 271.005(b), Local Government Code, is

amended to read as follows:

(b) The governing body of a governmental agency may contract

under this section for materials
, consultation, assistance,
and

labor incident to the installation
or use
of personal property.

SECTION 3. This Act takes effect September 1, 2025.
