A BILL TO BE ENTITLED

AN ACT

relating to the definition of short-barrel firearm for purposes of

certain criminal offenses.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 46.01, Penal Code, is amended by

amending Subdivision (10) to read as follows:

(10) "Short-barrel firearm" means a rifle with a

barrel length of less than 16 inches or a shotgun with a barrel

length of less than 18 inches, or any weapon made from a shotgun or

rifle if, as altered, it has an overall length of less than 26

inches.
The term does not include a handgun equipped with a

stabilizing brace designed to assist a person with handling the

handgun with one hand.

SECTION 2. The change in law made by this Act applies only

to an offense committed on or after the effective date of this Act.

An offense committed before the effective date of this Act is

governed by the law in effect on the date the offense was committed,

and the former law is continued in effect for that purpose. For

purposes of this section, an offense was committed before the

effective date of this Act if any element of the offense occurred

before that date.

SECTION 3. This Act takes effect September 1, 2025.
