A BILL TO BE ENTITLED

AN ACT

relating to the authority of a municipality to require a minimum

amount of parking spaces for certain commercial buildings.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter Z, Chapter 214, Local Government

Code, is amended by adding Section 214.909 to read as follows:

Sec.

214.909.

RESTRICTION ON REGULATION OF MINIMUM PARKING

REQUIREMENTS. (a) Notwithstanding any other law and except as

provided by Subsections (b) and (c), a municipality may not adopt or

enforce an ordinance, rule, or other regulation that requires a

minimum amount of parking spaces for a commercial building.

(b)

This section does not restrict a municipality from

regulating the provision of accessible parking designated for

persons with disabilities in accordance with state or federal law.

(c)

This section applies only to a building the construction

of which is completed on or after September 1, 2025.

SECTION 2. This Act takes effect September 1, 2025.
