A BILL TO BE ENTITLED

AN ACT

relating to access to a child's health records by the child's

parent, managing conservator, or guardian.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter A, Chapter 32, Family Code, is

amended by adding Section 32.006 to read as follows:

32.006.

ACCESS TO CHILD'S TREATMENT RECORDS.

Unless

limited by court order, a child's parent or, if applicable, the

child's managing conservator or guardian, is entitled to access to

the child's medical, dental, psychological, or surgical treatment

records, regardless of whether the parent, managing conservator, or

guardian:

(1) was required to consent to the treatment; or

(2) consented to the treatment.

SECTION 2. Subchapter A, Chapter 181, Health and Safety

Code, is amended by adding Section 181.007 to read as follows:

181.007.

PARENTAL ACCESS TO MEDICAL RECORDS OF MINOR

CHILD. (a)

In this section, "child" means a person younger than 18

years of age who is not and has not been married or who has not had

the disabilities of minority removed for general purposes.

(b)

Nothing in this chapter may be construed to limit the

right of a child's parent or, if applicable, the child's managing

conservator or guardian, to access to the child's health records

under other law.

SECTION 3. This Act takes effect September 1, 2025.
