A BILL TO BE ENTITLED
AN ACT
relating to certain duties of the Texas Board of Nursing and the
Texas Higher Education Coordinating Board in relation to the
reporting and publication of nursing program clinical site data.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 61, Education Code, is
amended by adding Section 61.066 to read as follows:
Sec.
61.066.
NURSING PROGRAM CLINICAL SITE DATA. (a) In
this section, "clinical site" has the meaning assigned by Section
61.9641.
(b)
The board shall annually publish information regarding
clinical sites approved by the Texas Board of Nursing for
professional nursing programs, including:
(1) the location of each clinical site;
(2)
the number of students receiving clinical training
at each clinical site; and
(3)
the total capacity at each clinical site for
nursing students to participate in clinical training.
(c)
This section may not be construed to authorize the board
to mandate all acute care or rehabilitation facilities, primary
care settings, long-term care facilities, nursing homes, and
residential care settings to participate in clinical education
programs or require additional reporting from those facilities.
SECTION 2. Subchapter D, Chapter 301, Occupations Code, is
amended by adding Section 301.169 to read as follows:
Sec.
301.169.
NURSING PROGRAM CLINICAL SITE DATA; ANNUAL
REPORT. (a) In this section:
(1)
"Clinical site" has the meaning assigned by
Section 61.9641, Education Code.
(2)
"Professional nursing program" has the meaning
assigned by Section 61.9621, Education Code.
(b) The board shall:
(1)
provide to the Texas Higher Education Coordinating
Board information detailing the requirements for approving
clinical sites for professional nursing programs; and
(2)
identify and provide a list to the Texas Higher
Education Coordinating Board of all acute care or rehabilitation
facilities, primary care settings, long-term care facilities,
nursing homes, residential care settings, and any other appropriate
sites not identified by the board as clinical sites that meet the
requirements described by Subdivision (1).
(c)
Not later than June 1 of each year, the board shall
prepare and provide to the Texas Higher Education Coordinating
Board a report with the information described by Section 61.066,
Education Code.
SECTION 3. Not later than June 1, 2026, the Texas Board of
Nursing shall prepare and submit the initial report required by
Section 301.169, Occupations Code, as added by this Act.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2025.
