A BILL TO BE ENTITLED

AN ACT

relating to the authority of certain counties to employ a county

purchasing agent.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 262.0115, Local Government Code, is

amended by amending Subsection (a) and adding Subsection (f) to

read as follows:

(a) In a county with a population of more than 100,000, the

commissioners court may employ a person to act as county purchasing

agent.

section does not apply to a county that has appointed a purchasing

agent under Section 262.011 and that has not abolished the position

as authorized by law.

(f)

This subsection applies only to a county for which the

board described by Section 262.011 has either appointed a county

purchasing agent and not abolished that office, or has abolished

that office.

The commissioners court of the county, after a public

hearing held on the matter, by order may employ a county purchasing

agent, regardless of whether the board has appointed another county

purchasing agent under Section 262.011.

If the commissioners court

employs a county purchasing agent under this subsection, the board

shall:

(1)

if applicable, remove the county purchasing agent

appointed by the board from office; and

(2)

transfer complete authority over the county

purchasing agent to the commissioners court.

SECTION 2. This Act takes effect immediately if it receives

a vote of two-thirds of all the members elected to each house, as

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
