A BILL TO BE ENTITLED

AN ACT

relating to the memorial designation of certain portions of an

international border wall and the use of grants related to homeland

security for those purposes.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 421.072, Government Code, is amended by

adding Subsection (d) to read as follows:

(d)

The governor may allocate available federal and state

grants and other funding related to homeland security to the Texas

Facilities Commission for expenses incurred by the commission in

designing, constructing, and maintaining memorial markers under

Subchapter D, Chapter 2152.

SECTION 2. Chapter 2152, Government Code, is amended by

adding Subchapter D to read as follows:

SUBCHAPTER D. NAMING OF INTERNATIONAL BORDER WALL

Sec.

2152.151.

DEFINITION. In this subchapter, "alien" has

the meaning assigned by Section 51.01, Penal Code.

Sec.

2152.152.

APPLICABILITY OF SUBCHAPTER. This

subchapter applies only to a border wall constructed by this state

on land owned by this state on its international border with the

United Mexican States.

Sec.

2152.153.

RESTRICTIONS ON NAMING BORDER WALL. (a)

Except as otherwise provided by statute, a part of a border wall may

not be designated by a name.

(b)

A part of a border wall may be designated by the name of

a person only if the person is deceased and was a victim of a crime,

including a border-related crime, committed by a person who is an

alien.

2152.154.

MEMORIAL MARKERS FOR NAMED PART OF BORDER

WALL. (a)

The commission shall erect each memorial marker required

by this subchapter.

(b)

Notwithstanding Subsection (a), the commission may not

design, construct, or erect a memorial marker unless a gift, grant,

or donation of funds is made to the commission to cover the cost of

the design, construction, and erection of the marker.

(c)

The commission shall repair and replace each memorial

marker required by this subchapter and maintain the grounds for the

marker.

(d)

The commission may accept a gift, grant, or donation

from any public or private source made to assist in financing the

construction and maintenance of a memorial marker.

SECTION 3. This Act takes effect September 1, 2025.
