A BILL TO BE ENTITLED

AN ACT

relating to the overnight parking of a commercial motor vehicle in

or near certain residential subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 545.307(a)(2), Transportation Code, is

amended to read as follows:

(2) "Residential subdivision" means a subdivision
:

(A) located
in a county with a population
:

(i)
greater than 220,000
; or

(ii)

less than 75,000 that is adjacent to

three counties with populations of more than 450,000;

(B)

: (A)
] for which a plat is recorded in the

county real property records; and

(C)
[
(B)
] in which the majority of lots are

subject to deed restrictions limiting the lots to residential use.

SECTION 2. This Act takes effect September 1, 2025.
