A BILL TO BE ENTITLED

AN ACT

relating to a limit on the number of athletic scholarships that may

be awarded to foreign students by a public institution of higher

education.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter Z, Chapter 51, Education Code, is

amended by adding Section 51.9247 to read as follows:

51.9247.

LIMIT ON NUMBER OF ATHLETIC SCHOLARSHIPS

AWARDED TO FOREIGN STUDENTS. (a)

In this section, "institution of

higher education" has the meaning assigned by Section 61.003.

(b)

For each intercollegiate athletic program, an

institution of higher education may not award for an academic year

to students who are citizens of a foreign country more than 25

percent of the athletic scholarships, grants, or similar financial

assistance conditioned on the student's participation in the

program that are available for the program for that academic year.

SECTION 2. Section 51.9247, Education Code, as added by

this Act, applies beginning with the 2026-2027 academic year.

SECTION 3. This Act takes effect September 1, 2025.
