A BILL TO BE ENTITLED

AN ACT

relating to a local option election on the sale of alcoholic

beverages in certain areas of a municipality and the local

regulation of premises in those areas.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Section 251.742, Alcoholic Beverage Code, is

amended by amending Subsection (b) and adding Subsection (i) to

read as follows:

(b) This section applies only to a municipality that:

(1) has a population of 15,000 or more[

] is located in two counties one of which:

(A) has a population of 340,000 or more;

(B) contains a municipality in which at least 85

percent of the county's population resides; and

(C) borders the Gulf of Mexico
; or

(2) has a population of 240,000 or more and:

(A) is located in two or more counties; and

(B)

borders a man-made lake that has a surface

area of at least 20,000 acres
.

(i)

Subject to Chapter 211, Local Government Code, the

governing body of the municipality may adopt zoning and land use

regulations applicable to a premises that sells alcoholic beverages

in the boundaries of a zone designated under this section.

SECTION 2. This Act takes effect September 1, 2025.
