A BILL TO BE ENTITLED

AN ACT

relating to the inspection of residential and day placement

facilities for special education students.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subchapter A, Chapter 29, Education Code, is

amended by adding Section 29.0101 to read as follows:

Sec.

29.0101.

INSPECTION OF RESIDENTIAL AND DAY PLACEMENT

FACILITIES. In conducting an inspection in accordance with the

monitoring system adopted under Section 29.010 of a residential

placement or day placement facility with which a school district

contracts to provide services to students with disabilities, the

agency shall consider whether:

(1)

educational services provided to a student placed

in a therapeutic environment in a residential or day placement at

the facility align with medical standards of care and best

practices for children with the student's disability; and

(2)

employees of the facility have undergone and

adhere to crisis prevention and intervention training.

SECTION 2. This Act applies beginning with the 2025-2026

school year.

SECTION 3. This Act takes effect immediately if it receives

a vote of two-thirds of all the members elected to each house, as

provided by Section 39, Article III, Texas Constitution. If this

Act does not receive the vote necessary for immediate effect, this

Act takes effect September 1, 2025.
