Nitrous Oxide Sales and Distribution Ban

This law makes it illegal to sell or distribute nitrous oxide devices for direct inhalation, flavored nitrous oxide, or large containers of nitrous oxide unless certain exceptions apply.

What This Bill Does

  • Makes it against the law to sell or give away a device that is made to deliver nitrous oxide through breathing in directly to anyone under 18 years old who does not fit into specific exceptions listed in the law.
  • Prohibits selling or giving away nitrous oxide that tastes or smells like food or drinks, such as fruits, candies, desserts, or alcoholic beverages, unless the buyer is exempted by the bill.
  • Bans selling containers of nitrous oxide larger than eight grams unless the buyer fits into specific exceptions listed in the law.

Who It Names or Affects

  • People who sell or distribute nitrous oxide and related products to individuals under 18 years old.
  • Individuals under 18 years of age looking to buy nitrous oxide devices for direct inhalation.
  • Businesses involved in catering supplies, food processing equipment, compressed gases for industrial use, health care providers, and institutions of higher education.

Terms To Know

Noxious chemical substances
Chemicals that are harmful or dangerous to breathe in, such as fingernail polish, model airplane glue, and nitrous oxide.
Diligent inquiry
A careful effort to find out if someone is 18 years old or older before selling them a device that delivers nitrous oxide for direct inhalation.

Limits and Unknowns

  • The law does not specify the exact penalties for violating these rules, only that they are Class 1 misdemeanors.
  • It's unclear how strictly sellers will be required to check buyers' ages before selling certain devices.
