AN ACT Relating to school safety capital grants; and adding a new 1
section to chapter 28A.525 RCW. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
NEW SECTION. Sec. 1. A new section is added to chapter 28A.525 4
RCW to read as follows: 5
(1) The office of the superintendent of public instruction may 6
administer a school safety capital grant program as provided for in 7
this section. 8
(2) Project eligibility. 9
(a) Grants provided pursuant to this section may only be awarded 10
for school safety projects that make physical improvements intended 11
to advance the safety or security of a school facility. Examples of 12
eligible project types under this section include, but are not 13
limited to: (i) Design and construction of security vestibules; (ii) 14
purchase and installation of metal detectors, facility key card 15
access, remote door access, panic buttons, or silent alarms; (iii) 16
fencing; (iv) lighting; and (v) crime prevention through 17
environmental design projects. 18
(b) Grantees must use grants awarded under this section to 19
incorporate, to the extent applicable to the project type, crime 20
prevention through environmental design principles.21

(3) Applicant eligibility. Common schools, state-tribal education 1
compact schools, and charter schools are eligible to apply for grants 2
under this section. For charter schools, the office of the 3
superintendent of public instruction may award grants only from 4
funding sources other than the common school construction fund.5
(4) Application process. Subject to the availability of amounts 6
appropriated for this specific purpose, the office of the 7
superintendent of public instruction shall develop a competitive 8
grant application process and assist eligible applicants in matters 9
related to applying for grants under this section.10
(5) Administration. 11
(a) The office of the superintendent of public instruction may 12
use up to three percent of amounts appropriated for the grant program 13
under this section for costs that result from administration of the 14
program. 15
(b) The office of the superintendent of public instruction shall 16
award grants under this section on a competitive basis and shall 17
adopt rules for this purpose. 18
(c) Prior to receiving funding, applicants for a grant under this 19
section must demonstrate that the project site is under their control 20
for a minimum of 10 years, either through ownership or a long-term 21
lease. 22
(d) In contracts for grants authorized under this section, the 23
office of the superintendent of public instruction shall include 24
provisions that require that capital improvements be held by the 25
grantee for a specified period of time appropriate to the amount of 26
the grant and that facilities be used for the express purpose of the 27
grant. If the office of the superintendent of public instruction 28
finds the grantee to be out of compliance with provisions of the 29
contract, the grantee shall repay the amount of the grant award to 30
the appropriate state fund, as determined by the office of the 31
superintendent of public instruction. If the source of grant funding 32
was general obligation bonds, then the repayment required for grant 33
noncompliance under this subsection must be made to the state general 34
fund and must include the principal amount of the grant plus interest 35
calculated at the rate of interest on state of Washington general 36
obligation bonds issued most closely to the date of authorization of 37
the grant. 38

(a) Except as provided for under (b) of this subsection, the 1
office of the superintendent of public instruction shall require 2
grantees under this section to provide matching nonstate funding 3
equal to at least 100 percent of the state grant award.4
(b) The office of the superintendent of public instruction shall 5
reduce the required matching percentage under (a) of this subsection 6
for applicants that have more than the statewide average percentage 7
of students eligible for free and reduced-price meals. When 8
determining a reduced nonstate match under this section, the office 9
of the superintendent of public instruction shall reduce the required 10
match only by the amount it deems necessary to enable the applicant's 11
participation in the grant program. However, a grantee receiving a 12
reduced match under this subsection must provide a minimum nonstate 13
match of at least 25 percent of the total estimated project cost 14
pursuant to subsection (7) of this section. 15
(7) Maximum project cost. Projects receiving a grant award under 16
this section must have a total estimated project cost of $1,000,000 17
or less. 18
