AN ACT Relating to protecting spouses by allowing the sharing of 1
benefits under the long-term services and supports trust program; and 2
adding a new section to chapter 50B.04 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 50B.04 5
RCW to read as follows: 6
(1) A qualified individual may elect to transfer any or all of 7
the qualified individual's available benefit units to the qualified 8
individual's spouse if the receiving spouse: 9
(a)(i) Does not meet the criteria to be a qualified individual 10
under RCW 50B.04.050; and 11
(ii) Following an evaluation, is determined to meet the 12
functional criteria necessary to become an eligible beneficiary as 13
established in RCW 50B.04.060; or 14
(b)(i) Has met the criteria to be a qualified individual under 15
RCW 50B.04.050; 16
(ii) Following an evaluation, is determined to meet the 17
functional criteria necessary to become an eligible beneficiary as 18
established in RCW 50B.04.060; and 19
(iii) Has exhausted the benefit units available to the receiving 20
spouse under the program. 21

amount of benefit units available to the qualified individual who 3
