AN ACT Relating to utilization of developmental disabilities 1
waivers; adding a new section to chapter 71A.10 RCW; and creating a 2
new section. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. The legislature finds that resources to 5
support people with developmental disabilities are limited and many 6
are in dire need of support. Enrollment into and receipt of 7
developmental disabilities administration home and community-based 8
services and supports can prevent traumatic and expensive hospital 9
stays and institutionalization as well as harm in communities leading 10
to incarceration. The legislature recognizes that until the state can 11
achieve a system capable of providing help as soon as help is needed 12
for all individuals with developmental disabilities, it is imperative 13
to strategically intervene at times of crisis so that populations for 14
which intervention is most critical are served without delay. 15
Therefore, the legislature intends to provide a clear prioritization 16
of populations most in need for developmental disabilities services 17
and supports.18

(1) When enrolling eligible clients in open home and community-1
based services waiver slots and for the purposes of determining 2
access to specific waiver services, to the extent consistent with 3
federal law and federal funding requirements, the administration 4
shall prioritize clients in the following populations:5
(a) Persons who are age 45 and older; 6
(b) Persons who, within the previous six months, have remained in 7
a hospital without a safe discharge plan; 8
(c) Persons who meet the criteria outlined in RCW 71A.12.370;9
(d) Persons who are discharging from institutional settings 10
including residential habilitation centers and state hospitals;11
(e) Persons the administration has determined to be in immediate 12
risk of admission to an intermediate care facility due to unmet 13
health and welfare needs; 14
(f) Persons who have been found incompetent to stand trial in a 15
criminal matter due to a developmental disability; and16
(g) Persons eligible for services under RCW 71A.12.090.17
(2) The administration shall align its rules to provide for the 18
prioritization for waiver slots and services for the populations 19
identified in subsection (1) of this section. 20
(3) The administration shall routinely collect data on the 21
following items related to home and community-based services waivers 22
and make the data publicly available on the administration's website:23
(a) The number of people enrolled in each waiver;24
(b) The capacity and waitlist, if any, for each waiver, including 25
the number of people from the prioritized populations identified in 26
subsection (1) of this section who are on a waitlist for waiver 27
enrollment; 28
(c) The number of people from the prioritized populations 29
identified in subsection (1) of this section that have been enrolled 30
on each waiver since the last report; 31
(d) Any requests for waiver services that have not been fulfilled 32
and the reason the request has not been fulfilled; and33
(e) Any unfulfilled requests for waiver services from the 34
prioritized populations identified in subsection (1) of this section, 35
including the type of service and the reason the request has not been 36
fulfilled. 37
