AN ACT Relating to transferring dedicated accounts for certain 1
professional licenses to the business and professions account; 2
amending RCW 43.24.150; creating a new section; repealing RCW 3
18.08.240, 18.39.810, 18.96.210, 18.140.260, 18.220.120, and 4
18.310.160; and providing an effective date. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:6
Sec. 1. RCW 43.24.150 and 2017 c 281 s 40 are each amended to 7
read as follows: 8
(1) The business and professions account is created in the state 9
treasury. All receipts from business or professional licenses, 10
registrations, certifications, renewals, examinations, or civil 11
penalties assessed and collected by the department from the following 12
chapters must be deposited into the account: 13
(a) Chapter 18.08 RCW, architects, except as provided in RCW 14
18.08.510;15
(b) Chapter 18.11 RCW, auctioneers; 16
(((b))) (c) Chapter 18.16 RCW, cosmetologists, barbers, and 17
manicurists; 18
(((c))) (d) Chapter 18.39 RCW, embalmers and funeral directors;19
(e) Chapter 18.96 RCW, landscape architects;20

Moneys in the account may be spent only after appropriation. 22
Expenditures from the account may be used only for expenses incurred 23
in carrying out these business and professions licensing activities 24
of the department. Any residue in the account must be accumulated and 25
may not revert to the general fund at the end of the biennium. 26
((However, during the 2013-2015 fiscal biennium the legislature may 27
transfer to the state general fund such amounts as reflect the excess 28
fund balance in the account.))29
(2) The director must biennially prepare a budget request based 30
on the anticipated costs of administering the business and 31
professions licensing activities listed in subsection (1) of this 32
section, which must include the estimated income from these business 33
and professions fees. 34
NEW SECTION. Sec. 2. The following acts or parts of acts are 35
each repealed:36

NEW SECTION. Sec. 3. Any residual balance of funds remaining, 10
as of December 31, 2025, in the architects' license account except as 11
provided in RCW 18.08.510, the funeral and cemetery account, the 12
landscape architects' license account, the real estate appraiser 13
commission account, the geologists' account, and the appraisal 14
management company account must be transferred to the business and 15
professions account in RCW 43.24.150. The treasurer shall make the 16
transfer after being notified by the office of financial management 17
that it has completed the financial statement for fiscal year 2025, 18
and no later than February 28, 2026.19
NEW SECTION. Sec. 4. This act takes effect January 1, 2026.20
