  • The director may require the testimony of witnesses and production of documents as part of an investigation.
  • (b) If the director determines a violation occurred, the director may issue a citation and notice of assessment and order the employer to pay to the complainant actual damages; statutory damages equal to the actual damages or $5,000, whichever is greater; interest of one percent per month on all compensation owed; payment to the department of the costs of investigation and enforcement; and any other appropriate relief.
  • (c) In addition to the citation and notice of assessment, the director may order payment to the department of a civil penalty.

AN ACT Relating to job postings requiring driver's licenses; and 1
adding a new section to chapter 49.60 RCW. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
NEW SECTION. Sec. 1. A new section is added to chapter 49.60 4
RCW to read as follows: 5
(1) It is an unfair practice for any employer to include a 6
statement in a job advertisement, posting, application, or other 7
material that an applicant must have a valid driver's license, unless 8
both of the following conditions are met: 9
(a) The employer reasonably expects driving to be one of the 10
essential job functions for the position; and 11
(b) The employer reasonably believes that satisfying the 12
essential job function using an alternative form of transportation 13
would not be comparable in travel time or cost to the employer.14
(2) For purposes of this section, "alternative form of 15
transportation" includes, but is not limited to, all of the 16
following: 17
(a) Using a ride hailing service; 18
(b) Using a taxi; 19
(c) Carpooling; 20
(d) Bicycling; 21
