AN ACT Relating to prohibiting government purchases of opioid 1
overdose reversal medications from certain entities; adding a new 2
section to chapter 70.14 RCW; and creating a new section.3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. The legislature finds that certain 5
corporations have been parties to settlements with state governments 6
over claims of having participated in causing or fueling the opioid 7
epidemic. Some of these same corporations are now selling opioid 8
overdose reversal medications to states. Whereas qualified and 9
capable pharmaceutical distributors exist that have not been a party 10
to these settlements, the state finds it critical to purchase opioid 11
overdose reversal medications from one or more of these distributors 12
that have not been found to have caused or fueled the opioid 13
epidemic.14
NEW SECTION. Sec. 2. A new section is added to chapter 70.14 15
RCW to read as follows: 16
(1) Except as provided in subsection (2) of this section, a state 17
agency, county, city, or town may not purchase an opioid overdose 18
reversal medication from an entity, including the entity's affiliates 19
or subsidiaries, which at the time of purchase, has been a party to a 20

settlement with any state government over claims of having 1
participated in causing or fueling the opioid epidemic.2
(2) An entity that has agreed to provide opioid overdose reversal 3
medications as part of a state settlement prior to September 1, 2024, 4
may continue to provide these medications until existing settlement 5
obligations are fulfilled. 6
(3) The department of health shall maintain a list on a public 7
website of the entities from which a state agency, county, city, or 8
town may not purchase opioid overdose reversal medications, as 9
described in subsection (1) of this section. 10
(4) "Opioid overdose reversal medication" has the same meaning as 11
provided in RCW 69.41.095. 12
