AN ACT Relating to establishing a behavioral health teaching 1
clinic designation and enhancement rate in Washington for eligible 2
licensed or certified behavioral health agencies; reenacting and 3
amending RCW 71.24.025; adding new sections to chapter 71.24 RCW; and 4
creating a new section. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:6
NEW SECTION. Sec. 1. (1) The legislature finds that:7
(a) Licensed or certified behavioral health agencies are the 8
essential safety net providers for adults, children, youth, and 9
families experiencing mental health or substance use disorders in 10
Washington; 11
(b) In addition to providing clinical services and care 12
coordination, licensed or certified behavioral health agencies serve 13
as the training ground for students and new graduates pursuing 14
behavioral health careers across sectors and settings, bearing the 15
cost for the essential training and supervision infrastructure that 16
sustains this crucial workforce development pipeline. Although there 17
are other health care settings that are compensated for their 18
interdisciplinary training and workforce development programs, 19
including teaching hospitals and federally qualified health centers, 20
the training role in community behavioral health is an unofficial and 21

uncompensated one, resulting in significant costs related to 1
supervising interns and new graduates when clinicians would otherwise 2
be providing billable direct services to patients; and3
(c) Competition among agencies for employing behavioral health 4
care workers is heightened and accelerating, and the compensation gap 5
between community behavioral health care providers and other practice 6
settings continues to grow. Because licensed or certified behavioral 7
health agencies serve primarily medicaid enrollees and are reliant on 8
inadequate medicaid reimbursement rates, they are unable to offer 9
competitive compensation packages to their employees and they 10
experience high turnover and vacancy rates as their workforce often 11
leaves for other settings offering higher compensation, lower 12
caseloads, and a less complex patient population. 13
(2) The legislature intends to establish the behavioral health 14
teaching clinic designation and enhancement rate to recognize and 15
compensate licensed or certified behavioral health agencies, 16
regardless of geographic location or tribal affiliation, for training 17
the broader behavioral health workforce in cutting edge, critical 18
behavioral health treatment modalities. 19
NEW SECTION. Sec. 2. A new section is added to chapter 71.24 20
RCW to read as follows: 21
(1) The director shall designate licensed or certified behavioral 22
health agencies that meet the state minimum standards described in 23
this section as behavioral health teaching clinics. To be eligible 24
for designation as a behavioral health teaching clinic, a licensed or 25
certified behavioral health agency must: 26
(a) Be a licensed or certified behavioral health agency in good 27
standing with the department; 28
(b) Train interns, trainees, or both; 29
(c) Attest that its organizational admissions policies and 30
procedures make the clinic equitable and inclusive to the populations 31
that it serves; 32
(d) Bill services rendered to clients by an intern or trainee and 33
receive reimbursement only in accordance with payors' and the 34
behavioral health agency's billing structures; 35
(e) Compensate interns with, at a minimum, a stipend or 36
honorarium in accordance with the teaching clinic payment structure 37
as described in subsection (4)(a) of this section and when not 38
prohibited by educational institutions; 39

(f) Provide interns and trainees with physical or virtual space 1
and resources similar to that of nonteaching clinic eligible staff 2
functioning in a similar role; 3
(g) Assign each intern or trainee to an appropriately 4
credentialed supervisor; 5
(h) Provide, at a minimum, the equivalent of one hour per week of 6
clinical supervision using the methods and deliveries determined by 7
the professional licensure standards of the profession that the 8
intern or trainee is pursuing; 9
(i) Require access to and oversight of an intern or trainee 10
during the internship or training to be provided by an assigned 11
supervisor who is employed or contracted by the teaching clinic, 12
either in person or virtually; 13
(j) Attest to having an active contract or agreement with each 14
intern's educational institution or program, which must either be 15
accredited or in the process of becoming accredited;16
(k) Attest to having formal orientation, training, and 17
observation processes and describe how the program ensures that 18
practice opportunities are provided to interns or trainees; and19
(l) Use continuous quality improvement strategies in the 20
operational practices, clinical practices, and strategic planning.21
(2) Behavioral health teaching clinics designated under 22
subsection (1) of this section must be reimbursed at an enhanced rate 23
as described in subsection (4)(a) of this section.24
(3) Designation as a behavioral health teaching clinic is 25
effective for three years from the date of issuance of the 26
designation. 27
(4) The authority shall collaborate with a statewide organization 28
representing licensed or certified behavioral health agencies to 29
establish a stakeholder group comprised of licensed or certified 30
behavioral health agencies and shall contract with an actuarial firm 31
to: 32
(a) Finalize the rate methodology for an enhanced rate for 33
designated behavioral health teaching clinics that builds upon 34
previous rate estimates, including the behavioral health teaching 35
clinic designation and enhancement rate demonstration project 36
stakeholder report, prepared by the Washington council for behavioral 37
health, December 2024; and 38
(b) Develop a plan for incremental implementation of statewide 39
designation of behavioral health teaching clinics by June 30, 2026.40

(5) Within its government-to-government relationship, the 1
authority shall consult with tribes and tribal government behavioral 2
health agencies to assure impacts of the teaching clinic designation 3
and enhanced rate methodology on tribal providers are well understood 4
and able to be implemented in a tribal behavioral health agency.5
(6) By June 30, 2027, the authority shall seek approval from the 6
federal centers for medicare and medicaid services to secure federal 7
financial participation in the costs of the enhancement rate for 8
operating a behavioral health teaching clinic. 9
(7) The authority shall submit a progress report to the governor 10
and the appropriate committees of the legislature by December 31, 11
2025, and a final report by December 31, 2026. 12
NEW SECTION. Sec. 3. A new section is added to chapter 71.24 13
RCW to read as follows: 14
(1) Upon submission of its training program to the department, 15
the department shall deem a licensed or certified behavioral health 16
agency that is a designated behavioral health teaching clinic under 17
section 2 of this act to have met all statutory and regulatory 18
behavioral health agency training requirements. 19
(2) The department, in consultation with the authority, licensed 20
or certified behavioral health agencies, and statewide organizations 21
representing licensed or certified behavioral health agencies, shall 22
adopt rules to implement this section by June 30, 2026.23
Sec. 4. RCW 71.24.025 and 2024 c 368 s 2, 2024 c 367 s 1, and 24
2024 c 121 s 25 are each reenacted and amended to read as follows:25
Unless the context clearly requires otherwise, the definitions in 26
this section apply throughout this chapter. 27
(1) "23-hour crisis relief center" means a community-based 28
facility or portion of a facility which is licensed or certified by 29
the department of health and open 24 hours a day, seven days a week, 30
offering access to mental health and substance use care for no more 31
than 23 hours and 59 minutes at a time per patient, and which accepts 32
all behavioral health crisis walk-ins drop-offs from first 33
responders, and individuals referred through the 988 system 34
regardless of behavioral health acuity, and meets the requirements 35
under RCW 71.24.916. 36
(2) "988 crisis hotline" means the universal telephone number 37
within the United States designated for the purpose of the national 38

suicide prevention and mental health crisis hotline system operating 1
through the national suicide prevention lifeline. 2
(3) "Acutely mentally ill" means a condition which is limited to 3
a short-term severe crisis episode of: 4
(a) A mental disorder as defined in RCW 71.05.020 or, in the case 5
of a child, as defined in RCW 71.34.020; 6
(b) Being gravely disabled as defined in RCW 71.05.020 or, in the 7
case of a child, a gravely disabled minor as defined in RCW 8
71.34.020; or 9
(c) Presenting a likelihood of serious harm as defined in RCW 10
71.05.020 or, in the case of a child, as defined in RCW 71.34.020.11
(4) "Alcoholism" means a disease, characterized by a dependency 12
on alcoholic beverages, loss of control over the amount and 13
circumstances of use, symptoms of tolerance, physiological or 14
psychological withdrawal, or both, if use is reduced or discontinued, 15
and impairment of health or disruption of social or economic 16
functioning. 17
(5) "Approved substance use disorder treatment program" means a 18
program for persons with a substance use disorder provided by a 19
treatment program licensed or certified by the department as meeting 20
standards adopted under this chapter. 21
(6) "Authority" means the Washington state health care authority.22
(7) "Available resources" means funds appropriated for the 23
purpose of providing community behavioral health programs, federal 24
funds, except those provided according to Title XIX of the Social 25
Security Act, and state funds appropriated under this chapter or 26
chapter 71.05 RCW by the legislature during any biennium for the 27
purpose of providing residential services, resource management 28
services, community support services, and other behavioral health 29
services. This does not include funds appropriated for the purpose of 30
operating and administering the state psychiatric hospitals.31
(8) "Behavioral health administrative services organization" 32
means an entity contracted with the authority to administer 33
behavioral health services and programs under RCW 71.24.381, 34
including crisis services and administration of chapter 71.05 RCW, 35
the involuntary treatment act, for all individuals in a defined 36
regional service area. 37
(9) "Behavioral health aide" means a counselor, health educator, 38
and advocate who helps address individual and community-based 39
behavioral health needs, including those related to alcohol, drug, 40

and tobacco abuse as well as mental health problems such as grief, 1
depression, suicide, and related issues and is certified by a 2
community health aide program of the Indian health service or one or 3
more tribes or tribal organizations consistent with the provisions of 4
25 U.S.C. Sec. 1616l and RCW 43.71B.010 (7) and (8).5
(10) "Behavioral health provider" means a person licensed under 6
chapter 18.57, 18.71, 18.71A, 18.83, 18.205, 18.225, or 18.79 RCW, as 7
it applies to registered nurses and advanced practice registered 8
((nurse practitioners)) nurses. 9
(11) "Behavioral health services" means mental health services, 10
substance use disorder treatment services, and co-occurring disorder 11
treatment services as described in this chapter and chapter 71.36 RCW 12
that, depending on the type of service, are provided by licensed or 13
certified behavioral health agencies, behavioral health providers, or 14
integrated into other health care providers. 15
(12) "Behavioral health teaching clinic" means a licensed or 16
certified behavioral health agency that meets the teaching clinic 17
standards and billing eligibility as described in section 2 of this 18
act to provide high quality, evidence-based training and clinical 19
supervision to behavioral health interns and trainees.20
(13) "Child" means a person under the age of 18 years.21
(((13)))(14) "Chronically mentally ill adult" or "adult who is 22
chronically mentally ill" means an adult who has a mental disorder 23
and meets at least one of the following criteria: 24
(a) Has undergone two or more episodes of hospital care for a 25
mental disorder within the preceding two years; or26
(b) Has experienced a continuous behavioral health 27
hospitalization or residential treatment exceeding six months' 28
duration within the preceding year; or 29
(c) Has been unable to engage in any substantial gainful activity 30
by reason of any mental disorder which has lasted for a continuous 31
period of not less than 12 months. "Substantial gainful activity" 32
shall be defined by the authority by rule consistent with Public Law 33
92-603, as amended. 34
(((14))) (15) "Clubhouse" means a community-based program that 35
provides rehabilitation services and is licensed or certified by the 36
department. 37
(((15))) (16) "Community behavioral health program" means all 38
expenditures, services, activities, or programs, including reasonable 39
administration and overhead, designed and conducted to prevent or 40

treat substance use disorder, mental illness, or both in the 1
community behavioral health system. 2
(((16))) (17) "Community behavioral health service delivery 3
system" means public, private, or tribal agencies that provide 4
services specifically to persons with mental disorders, substance use 5
disorders, or both, as defined under RCW 71.05.020 and receive 6
funding from public sources. 7
(((17))) (18) "Community support services" means services 8
authorized, planned, and coordinated through resource management 9
services including, at a minimum, assessment, diagnosis, emergency 10
crisis intervention available 24 hours, seven days a week, 11
prescreening determinations for persons who are mentally ill being 12
considered for placement in nursing homes as required by federal law, 13
screening for patients being considered for admission to residential 14
services, diagnosis and treatment for children who are acutely 15
mentally ill or severely emotionally or behaviorally disturbed 16
discovered under screening through the federal Title XIX early and 17
periodic screening, diagnosis, and treatment program, investigation, 18
legal, and other nonresidential services under chapter 71.05 RCW, 19
case management services, psychiatric treatment including medication 20
supervision, counseling, psychotherapy, assuring transfer of relevant 21
patient information between service providers, recovery services, and 22
other services determined by behavioral health administrative 23
services organizations. 24
(((18))) (19) "Community-based crisis team" means a team that is 25
part of an emergency medical services agency, a fire service agency, 26
a public health agency, a medical facility, a nonprofit crisis 27
response provider, or a city or county government entity, other than 28
a law enforcement agency, that provides the on-site community-based 29
interventions of a mobile rapid response crisis team for individuals 30
who are experiencing a behavioral health crisis. 31
(((19))) (20) "Consensus-based" means a program or practice that 32
has general support among treatment providers and experts, based on 33
experience or professional literature, and may have anecdotal or case 34
study support, or that is agreed but not possible to perform studies 35
with random assignment and controlled groups. 36
(((20))) (21) "Coordinated regional behavioral health crisis 37
response system" means the coordinated operation of 988 call centers, 38
regional crisis lines, certified public safety telecommunicators, and 39

other behavioral health crisis system partners within each regional 1
service area. 2
(((21))) (22) "County authority" means the board of county 3
commissioners, county council, or county executive having authority 4
to establish a behavioral health administrative services 5
organization, or two or more of the county authorities specified in 6
this subsection which have entered into an agreement to establish a 7
behavioral health administrative services organization.8
(((22))) (23) "Crisis stabilization services" means services such 9
as 23-hour crisis relief centers, crisis stabilization units, short-10
term respite facilities, peer-run respite services, and same-day 11
walk-in behavioral health services, including within the overall 12
crisis system components that operate like hospital emergency 13
departments that accept all walk-ins, and ambulance, fire, and police 14
drop-offs, or determine the need for involuntary hospitalization of 15
an individual. 16
(((23))) (24) "Crisis stabilization unit" has the same meaning as 17
under RCW 71.05.020. 18
(((24))) (25) "Department" means the department of health.19
(((25))) (26) "Designated 988 contact hub" or "988 contact hub" 20
means a state-designated contact center that streamlines clinical 21
interventions and access to resources for people experiencing a 22
behavioral health crisis and participates in the national suicide 23
prevention lifeline network to respond to statewide or regional 988 24
contacts that meets the requirements of RCW 71.24.890.25
(((26))) (27) "Designated crisis responder" has the same meaning 26
as in RCW 71.05.020. 27
(((27))) (28) "Director" means the director of the authority.28
(((28))) (29) "Drug addiction" means a disease characterized by a 29
dependency on psychoactive chemicals, loss of control over the amount 30
and circumstances of use, symptoms of tolerance, physiological or 31
psychological withdrawal, or both, if use is reduced or discontinued, 32
and impairment of health or disruption of social or economic 33
functioning. 34
(((29))) (30) "Early adopter" means a regional service area for 35
which all of the county authorities have requested that the authority 36
purchase medical and behavioral health services through a managed 37
care health system as defined under RCW 71.24.380(7).38
(((30))) (31) "Emerging best practice" or "promising practice" 39
means a program or practice that, based on statistical analyses or a 40

well established theory of change, shows potential for meeting the 1
evidence-based or research-based criteria, which may include the use 2
of a program that is evidence-based for outcomes other than those 3
listed in subsection (((31))) (32) of this section.4
(((31))) (32) "Evidence-based" means a program or practice that 5
has been tested in heterogeneous or intended populations with 6
multiple randomized, or statistically controlled evaluations, or 7
both; or one large multiple site randomized, or statistically 8
controlled evaluation, or both, where the weight of the evidence from 9
a systemic review demonstrates sustained improvements in at least one 10
outcome. "Evidence-based" also means a program or practice that can 11
be implemented with a set of procedures to allow successful 12
replication in Washington and, when possible, is determined to be 13
cost-beneficial. 14
(((32))) (33) "First responders" includes ambulance, fire, mobile 15
rapid response crisis team, coresponder team, designated crisis 16
responder, fire department mobile integrated health team, community 17
assistance referral and education services program under RCW 18
35.21.930, and law enforcement personnel. 19
(((33))) (34) "Immediate jeopardy" means a situation in which the 20
licensed or certified behavioral health agency's noncompliance with 21
one or more statutory or regulatory requirements has placed the 22
health and safety of patients in its care at risk for serious injury, 23
serious harm, serious impairment, or death. 24
(((34))) (35) "Indian health care provider" means a health care 25
program operated by the Indian health service or by a tribe, tribal 26
organization, or urban Indian organization as those terms are defined 27
in the Indian health care improvement act (25 U.S.C. Sec. 1603).28
(((35))) (36) "Intensive behavioral health treatment facility" 29
means a community-based specialized residential treatment facility 30
for individuals with behavioral health conditions, including 31
individuals discharging from or being diverted from state and local 32
hospitals, whose impairment or behaviors do not meet, or no longer 33
meet, criteria for involuntary inpatient commitment under chapter 34
71.05 RCW, but whose care needs cannot be met in other community-35
based placement settings. 36
(((36))) (37) "Intern" means an individual in a bachelor's degree 37
program, master's degree program, or educational institution or 38
program, which must either be accredited or in the process of 39

becoming accredited, who is seeking behavioral health training as 1
part of the degree program. 2
(38) "Licensed or certified behavioral health agency" means:3
(a) An entity licensed or certified according to this chapter or 4
chapter 71.05 RCW; 5
(b) An entity deemed to meet state minimum standards as a result 6
of accreditation by a recognized behavioral health accrediting body 7
recognized and having a current agreement with the department; or8
(c) An entity with a tribal attestation that it meets state 9
minimum standards for a licensed or certified behavioral health 10
agency. 11
(((37))) (39) "Licensed physician" means a person licensed to 12
practice medicine or osteopathic medicine and surgery in the state of 13
Washington. 14
(((38))) (40) "Long-term inpatient care" means inpatient services 15
for persons committed for, or voluntarily receiving intensive 16
treatment for, periods of 90 days or greater under chapter 71.05 RCW. 17
"Long-term inpatient care" as used in this chapter does not include: 18
(a) Services for individuals committed under chapter 71.05 RCW who 19
are receiving services pursuant to a conditional release or a court-20
ordered less restrictive alternative to detention; or (b) services 21
for individuals voluntarily receiving less restrictive alternative 22
treatment on the grounds of the state hospital. 23
(((39))) (41) "Managed care organization" means an organization, 24
having a certificate of authority or certificate of registration from 25
the office of the insurance commissioner, that contracts with the 26
authority under a comprehensive risk contract to provide prepaid 27
health care services to enrollees under the authority's managed care 28
programs under chapter 74.09 RCW. 29
(((40))) (42) "Mental health peer-run respite center" means a 30
peer-run program to serve individuals in need of voluntary, short-31
term, noncrisis services that focus on recovery and wellness.32
(((41))) (43) Mental health "treatment records" include 33
registration and all other records concerning persons who are 34
receiving or who at any time have received services for mental 35
illness, which are maintained by the department of social and health 36
services or the authority, by behavioral health administrative 37
services organizations and their staffs, by managed care 38
organizations and their staffs, or by treatment facilities. 39
"Treatment records" do not include notes or records maintained for 40

personal use by a person providing treatment services for the 1
entities listed in this subsection, or a treatment facility if the 2
notes or records are not available to others. 3
(((42))) (44) "Mentally ill persons," "persons who are mentally 4
ill," and "the mentally ill" mean persons and conditions defined in 5
subsections (3), (((13), (51), and (52))) (14), (53), and (54) of 6
this section. 7
(((43))) (45) "Mobile rapid response crisis team" means a team 8
that provides professional on-site community-based intervention such 9
as outreach, de-escalation, stabilization, resource connection, and 10
follow-up support for individuals who are experiencing a behavioral 11
health crisis, that shall include certified peer counselors as a best 12
practice to the extent practicable based on workforce availability, 13
and that meets standards for response times established by the 14
authority. 15
(((44))) (46) "Recovery" means a process of change through which 16
individuals improve their health and wellness, live a self-directed 17
life, and strive to reach their full potential. 18
(((45))) (47) "Regional crisis line" means the behavioral health 19
crisis hotline in each regional service area which provides crisis 20
response services 24 hours a day, seven days a week, 365 days a year 21
including but not limited to dispatch of mobile rapid response crisis 22
teams, community-based crisis teams, and designated crisis 23
responders. 24
(((46))) (48) "Research-based" means a program or practice that 25
has been tested with a single randomized, or statistically controlled 26
evaluation, or both, demonstrating sustained desirable outcomes; or 27
where the weight of the evidence from a systemic review supports 28
sustained outcomes as described in subsection (((31))) (32) of this 29
section but does not meet the full criteria for evidence-based.30
(((47))) (49) "Residential services" means a complete range of 31
residences and supports authorized by resource management services 32
and which may involve a facility, a distinct part thereof, or 33
services which support community living, for persons who are acutely 34
mentally ill, adults who are chronically mentally ill, children who 35
are severely emotionally disturbed, or adults who are seriously 36
disturbed and determined by the behavioral health administrative 37
services organization or managed care organization to be at risk of 38
becoming acutely or chronically mentally ill. The services shall 39
include at least evaluation and treatment services as defined in 40

chapter 71.05 RCW, acute crisis respite care, long-term adaptive and 1
rehabilitative care, and supervised and supported living services, 2
and shall also include any residential services developed to service 3
persons who are mentally ill in nursing homes, residential treatment 4
facilities, assisted living facilities, and adult family homes, and 5
may include outpatient services provided as an element in a package 6
of services in a supported housing model. Residential services for 7
children in out-of-home placements related to their mental disorder 8
shall not include the costs of food and shelter, except for 9
children's long-term residential facilities existing prior to January 10
1, 1991. 11
(((48))) (50) "Resilience" means the personal and community 12
qualities that enable individuals to rebound from adversity, trauma, 13
tragedy, threats, or other stresses, and to live productive lives.14
(((49))) (51) "Resource management services" mean the planning, 15
coordination, and authorization of residential services and community 16
support services administered pursuant to an individual service plan 17
for: (a) Adults and children who are acutely mentally ill; (b) adults 18
who are chronically mentally ill; (c) children who are severely 19
emotionally disturbed; or (d) adults who are seriously disturbed and 20
determined by a behavioral health administrative services 21
organization or managed care organization to be at risk of becoming 22
acutely or chronically mentally ill. Such planning, coordination, and 23
authorization shall include mental health screening for children 24
eligible under the federal Title XIX early and periodic screening, 25
diagnosis, and treatment program. Resource management services 26
include seven day a week, 24 hour a day availability of information 27
regarding enrollment of adults and children who are mentally ill in 28
services and their individual service plan to designated crisis 29
responders, evaluation and treatment facilities, and others as 30
determined by the behavioral health administrative services 31
organization or managed care organization, as applicable.32
(((50))) (52) "Secretary" means the secretary of the department 33
of health. 34
(((51))) (53) "Seriously disturbed person" means a person who:35
(a) Is gravely disabled or presents a likelihood of serious harm 36
to himself or herself or others, or to the property of others, as a 37
result of a mental disorder as defined in chapter 71.05 RCW;38
(b) Has been on conditional release status, or under a less 39
restrictive alternative order, at some time during the preceding two 40

years from an evaluation and treatment facility or a state mental 1
health hospital; 2
(c) Has a mental disorder which causes major impairment in 3
several areas of daily living; 4
(d) Exhibits suicidal preoccupation or attempts; or5
(e) Is a child diagnosed by a mental health professional, as 6
defined in chapter 71.34 RCW, as experiencing a mental disorder which 7
is clearly interfering with the child's functioning in family or 8
school or with peers or is clearly interfering with the child's 9
personality development and learning. 10
(((52))) (54) "Severely emotionally disturbed child" or "child 11
who is severely emotionally disturbed" means a child who has been 12
determined by the behavioral health administrative services 13
organization or managed care organization, if applicable, to be 14
experiencing a mental disorder as defined in chapter 71.34 RCW, 15
including those mental disorders that result in a behavioral or 16
conduct disorder, that is clearly interfering with the child's 17
functioning in family or school or with peers and who meets at least 18
one of the following criteria: 19
(a) Has undergone inpatient treatment or placement outside of the 20
home related to a mental disorder within the last two years;21
(b) Has undergone involuntary treatment under chapter 71.34 RCW 22
within the last two years; 23
(c) Is currently served by at least one of the following child-24
serving systems: Juvenile justice, child-protection/welfare, special 25
education, or developmental disabilities; 26
(d) Is at risk of escalating maladjustment due to:27
(i) Chronic family dysfunction involving a caretaker who is 28
mentally ill or inadequate; 29
(ii) Changes in custodial adult; 30
(iii) Going to, residing in, or returning from any placement 31
outside of the home, for example, behavioral health hospital, short-32
term inpatient, residential treatment, group or foster home, or a 33
correctional facility; 34
(iv) Subject to repeated physical abuse or neglect;35
(v) Drug or alcohol abuse; or 36
(vi) Homelessness. 37
(((53))) (55) "State minimum standards" means minimum 38
requirements established by rules adopted and necessary to implement 39
this chapter by: 40

(a) The authority for: 1
(i) Delivery of mental health and substance use disorder 2
services; and 3
(ii) Community support services and resource management services;4
(b) The department of health for: 5
(i) Licensed or certified behavioral health agencies for the 6
purpose of providing mental health or substance use disorder programs 7
and services, or both; 8
(ii) Licensed behavioral health providers for the provision of 9
mental health or substance use disorder services, or both; and10
(iii) Residential services. 11
(((54))) (56) "Substance use disorder" means a cluster of 12
cognitive, behavioral, and physiological symptoms indicating that an 13
individual continues using the substance despite significant 14
substance-related problems. The diagnosis of a substance use disorder 15
is based on a pathological pattern of behaviors related to the use of 16
the substances. 17
(((55))) (57) "Trainee" means an individual behavioral health 18
professional who is a prelicensure candidate gaining the supervision 19
and supervised experience necessary to be a fully licensed behavioral 20
health professional. The term includes licensed advanced social 21
worker associates, licensed independent clinical social worker 22
associates, licensed mental health counselor associates, licensed 23
marriage and family therapist associates, certified substance use 24
disorder professional trainees, and licensed psychological 25
associates.26
(58) "Tribe," for the purposes of this section, means a federally 27
recognized Indian tribe. 28
