AN ACT Relating to reporting information related to racial 1
disproportionality in child welfare; and adding a new section to 2
chapter 74.13 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 74.13 5
RCW to read as follows: 6
(1) By September 1, 2026, and biennially thereafter, the 7
department shall, in compliance with RCW 43.01.036, submit a report 8
to the appropriate committees of the legislature that provides data 9
regarding racial disproportionality in child welfare and 10
recommendations to address that disproportionality and meets the 11
requirements of this section, with a preliminary report due October 12
1, 2025. 13
(2) The report required under this section must include, but is 14
not limited to, the following information, from at least the last 15
five years of available information, disaggregated by race:16
(a) Child abuse referrals; 17
(b) Child neglect referrals; 18
(c) Child neglect referrals that screen in for investigation;19
(d) Child abuse referrals that screen in for investigation;20

(e) Families receiving a family assessment response as defined in 1
RCW 26.44.020; 2
(f) Families for which the department provides a referral for 3
prevention services; 4
(g) Families who receive prevention services; 5
(h) Children who are dependent under chapter 13.34 RCW who 6
receive a guardian appointed by the court under RCW 13.36.050, a 7
guardianship under RCW 11.130.215, or who receive a guardian 8
appointed by a tribal court under RCW 74.13.031(17);9
(i) The length of time that children who are dependent under 10
chapter 13.34 RCW spend as a dependent, in foster care, with 11
relatives, in group care, with a parent or guardian while still 12
dependent, or in other placements; and 13
(j) Employees of the department separated by job classification 14
highlighting leadership and supervisory positions separately from 15
nonleadership and nonsupervisory positions. 16
(3) In addition to the information required under subsection (2) 17
of this section, the report required under this section must include:18
(a) The efforts taken by the department to address racial 19
disproportionality in child welfare; 20
(b) The outcome measures used by the department to gauge 21
improvement in addressing racial disproportionality in child welfare;22
(c) Recommendations regarding policy, practice, or funding 23
changes that could reduce racial disproportionality in child welfare;24
(d) Updates on implementing the child welfare redesign; and25
(e) Updates from the assessment oversight group within the 26
department regarding monitoring the use of assessments, approving the 27
selection of new tools, and coordinating assessment tools that are 28
related to racial disproportionality in child welfare.29
