AN ACT Relating to exempting certain data related to American 1
Indians, Alaska Natives, and Indian tribes from public inspection and 2
copying; amending RCW 42.56.010; and adding a new section to chapter 3
42.56 RCW. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
Sec. 1. RCW 42.56.010 and 2022 c 71 s 6 are each amended to read 6
as follows: 7
The definitions in this section apply throughout this chapter 8
unless the context clearly requires otherwise. 9
(1) "Agency" includes all state agencies and all local agencies. 10
"State agency" includes every state office, department, division, 11
bureau, board, commission, or other state agency. "Local agency" 12
includes every county, city, town, municipal corporation, quasi-13
municipal corporation, or special purpose district, or any office, 14
department, division, bureau, board, commission, or agency thereof, 15
or other local public agency. "Agency" does not include a 16
comprehensive cancer center participating in a collaborative 17
arrangement as defined in RCW 28B.10.930 that is operated in 18
conformance with RCW 28B.10.930. 19

(2) "Indian tribe" or "tribe" means any federally recognized 1
Indian tribe whose traditional lands and territories included parts 2
of Washington.3
(3) "Person in interest" means the person who is the subject of a 4
record or any representative designated by that person, except that 5
if that person is under a legal disability, "person in interest" 6
means and includes the parent or duly appointed legal representative.7
(((3))) (4) "Public record" includes any writing containing 8
information relating to the conduct of government or the performance 9
of any governmental or proprietary function prepared, owned, used, or 10
retained by any state or local agency regardless of physical form or 11
characteristics. For the office of the secretary of the senate and 12
the office of the chief clerk of the house of representatives, public 13
records means legislative records as defined in RCW 40.14.100 and 14
also means the following: All budget and financial records; personnel 15
leave, travel, and payroll records; records of legislative sessions; 16
reports submitted to the legislature; and any other record designated 17
a public record by any official action of the senate or the house of 18
representatives. This definition does not include records that are 19
not otherwise required to be retained by the agency and are held by 20
volunteers who: 21
(a) Do not serve in an administrative capacity;22
(b) Have not been appointed by the agency to an agency board, 23
commission, or internship; and 24
(c) Do not have a supervisory role or delegated agency authority.25
(((4))) (5) "Writing" means handwriting, typewriting, printing, 26
photostating, photographing, and every other means of recording any 27
form of communication or representation including, but not limited 28
to, letters, words, pictures, sounds, or symbols, or combination 29
thereof, and all papers, maps, magnetic or paper tapes, photographic 30
films and prints, motion picture, film and video recordings, magnetic 31
or punched cards, discs, drums, diskettes, sound recordings, and 32
other documents including existing data compilations from which 33
information may be obtained or translated. 34
NEW SECTION. Sec. 2. A new section is added to chapter 42.56 35
RCW to read as follows: 36
The following information relating to American Indians, Alaska 37
Natives, and Indian tribes is exempt from public inspection and 38
copying under this chapter: Any information pertaining to American 39

Indians, Alaska Natives, or Indian tribes prepared, owned, used, or 1
retained by the agencies listed in RCW 43.71B.020(1)(b)(i) or by 2
local health jurisdictions as defined in RCW 43.70.575.3
