AN ACT Relating to prohibiting certain contracting practices by a 1
health carrier acting as a third-party administrator for self-insured 2
coverage offered to public employees; and adding a new section to 3
chapter 41.05 RCW. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
NEW SECTION. Sec. 1. A new section is added to chapter 41.05 6
RCW to read as follows: 7
(1) A health carrier acting as a third-party administrator for a 8
self-funded plan offered to employees or school employees under this 9
chapter may not require a hospital system owned or operated by the 10
state of Washington to participate in any commercial health plan or 11
product offered or administered by the health carrier as a condition 12
for negotiations or participation in the self-funded plan.13
(2) For purposes of this section, "health carrier" has the same 14
meaning as in RCW 48.43.005. 15
