AN ACT Relating to law enforcement officers participating in 1
college and technical school programs; amending RCW 42.52.120; adding 2
a new section to chapter 28B.50 RCW; and creating a new section.3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. The legislature finds that the Washington 5
state board of community and technical colleges in the September 2024 6
law enforcement and corrections workforce needs assessment reported 7
that several criminal justice instructors had difficulty establishing 8
relationships with local law enforcement on behalf of students 9
seeking connections. A central recommendation emerging from the 10
research study is to rebuild relationships between the institutions 11
that educate future public servants and the local agencies that 12
employ them. This bill intends to provide an incentive for law 13
enforcement officers to participate when college instructors ask for 14
law enforcement to share real life expertise in their courses.15
NEW SECTION. Sec. 2. A new section is added to chapter 28B.50 16
RCW to read as follows: 17
(1) The legislature finds that involvement by certified law 18
enforcement officers in college and technical school programs can 19
help improve the image of law enforcement within communities 20

throughout the state, create positive interactions with potential 1
recruits, and inspire individuals to consider a career in law 2
enforcement. A law enforcement officer's duties do not include any 3
obligation to interact with college and technical school programs in 4
such a manner. 5
(2) An institution of higher education, as defined in RCW 6
28B.10.016, may engage a general or limited authority Washington 7
peace officer as defined in RCW 10.93.020 to receive honoraria for 8
delivering presentations as part of a criminal justice associate, law 9
enforcement, police science, financial forensics and fraud, or 10
forensic science and technology course. Such payment is only 11
appropriate when the presentation occurs outside of the law 12
enforcement officer's official duties. 13
Sec. 3. RCW 42.52.120 and 1997 c 318 s 1 are each amended to 14
read as follows: 15
(1) No state officer or state employee may receive any thing of 16
economic value under any contract or grant outside of his or her 17
official duties. The prohibition in this subsection does not apply 18
where the state officer or state employee has complied with RCW 19
42.52.030(((2))) or each of the following conditions are met:20
(a) The contract or grant is bona fide and actually performed;21
(b) The performance or administration of the contract or grant is 22
not within the course of the officer's or employee's official duties, 23
or is not under the officer's or employee's official supervision;24
(c) The performance of the contract or grant is not prohibited by 25
RCW 42.52.040 or by applicable laws or rules governing outside 26
employment for the officer or employee; 27
(d) The contract or grant is neither performed for nor 28
compensated by any person from whom such officer or employee would be 29
prohibited by RCW 42.52.150(4) from receiving a gift;30
(e) The contract or grant is not one expressly created or 31
authorized by the officer or employee in his or her official 32
capacity; 33
(f) The contract or grant would not require unauthorized 34
disclosure of confidential information. 35
(2) In addition to satisfying the requirements of subsection (1) 36
of this section, a state officer or state employee may have a 37
beneficial interest in a grant or contract or a series of 38

substantially identical contracts or grants with a state agency only 1
if: 2
(a) The contract or grant is awarded or issued as a result of an 3
open and competitive bidding process in which more than one bid or 4
grant application was received; or 5
(b) The contract or grant is awarded or issued as a result of an 6
open and competitive bidding or selection process in which the 7
officer's or employee's bid or proposal was the only bid or proposal 8
received and the officer or employee has been advised by the 9
appropriate ethics board, before execution of the contract or grant, 10
that the contract or grant would not be in conflict with the proper 11
discharge of the officer's or employee's official duties; or12
(c) The process for awarding the contract or issuing the grant is 13
not open and competitive, but the officer or employee has been 14
advised by the appropriate ethics board that the contract or grant 15
would not be in conflict with the proper discharge of the officer's 16
or employee's official duties. 17
(3) A state officer or state employee awarded a contract or 18
issued a grant in compliance with subsection (2) of this section 19
shall file the contract or grant with the appropriate ethics board 20
within thirty days after the date of execution; however, if 21
proprietary formulae, designs, drawings, or research are included in 22
the contract or grant, the proprietary formulae, designs, drawings, 23
or research may be deleted from the contract or grant filed with the 24
appropriate ethics board. 25
(4) This section does not prevent a state officer or state 26
employee from receiving compensation contributed from the treasury of 27
the United States, another state, county, or municipality if the 28
compensation is received pursuant to arrangements entered into 29
between such state, county, municipality, or the United States and 30
the officer's or employee's agency. This section does not prohibit a 31
state officer or state employee from serving or performing any duties 32
under an employment contract with a governmental entity.33
(5) As used in this section, "officer" and "employee" do not 34
include officers and employees who, in accordance with the terms of 35
their employment or appointment, are serving without compensation 36
from the state of Washington or are receiving from the state only 37
reimbursement of expenses incurred or a predetermined allowance for 38
such expenses. 39

(6) This section does not prevent a general or limited authority 1
Washington peace officer as defined in RCW 10.93.020 from receiving 2
honoraria when delivering presentations as part of a criminal justice 3
associate, law enforcement, police science, financial forensics and 4
fraud, or forensic science and technology course in accordance with 5
section 2 of this act.6
