AN ACT Relating to the effective delivery and administration of 1
basic education services to justice-involved students; amending RCW 2
28A.300.040, 28A.300.850, and 28A.190.150; and providing an 3
expiration date. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
Sec. 1. RCW 28A.300.040 and 2023 c 303 s 3 are each amended to 6
read as follows: 7
In addition to any other powers and duties as provided by law, 8
the powers and duties of the superintendent of public instruction 9
shall be: 10
(1) To have supervision over all matters pertaining to the public 11
schools of the state; 12
(2) To report to the governor and the legislature such 13
information and data as may be required for the management and 14
improvement of the schools; 15
(3) To prepare and have printed such forms, registers, courses of 16
study, rules for the government of the common schools, and such other 17
material and books as may be necessary for the discharge of the 18
duties of teachers and officials charged with the administration of 19
the laws relating to the common schools, and to distribute the same 20
to educational service district superintendents; 21

(4) To travel, without neglecting his or her other official 1
duties as superintendent of public instruction, for the purpose of 2
attending educational meetings or conventions, of visiting schools, 3
and of consulting educational service district superintendents or 4
other school officials; 5
(5) To prepare and from time to time to revise a manual of the 6
Washington state common school code, copies of which shall be made 7
available online and which shall be sold at approximate actual cost 8
of publication and distribution per volume to public and nonpublic 9
agencies or individuals, said manual to contain Titles 28A and 28C 10
RCW, rules related to the common schools, and such other matter as 11
the state superintendent or the state board of education shall 12
determine; 13
(6) To file all papers, reports and public documents transmitted 14
to the superintendent by the school officials of the several counties 15
or districts of the state, each year separately. Copies of all papers 16
filed in the superintendent's office, and the superintendent's 17
official acts, may, or upon request, shall be certified by the 18
superintendent and attested by the superintendent's official seal, 19
and when so certified shall be evidence of the papers or acts so 20
certified to; 21
(7) To require annually, on or before the 15th day of August, of 22
the president, manager, or principal of every educational institution 23
in this state, a report as required by the superintendent of public 24
instruction; and it is the duty of every president, manager, or 25
principal, to complete and return such forms within such time as the 26
superintendent of public instruction shall direct;27
(8) To keep in the superintendent's office a record of all 28
teachers receiving certificates to teach in the common schools of 29
this state; 30
(9) To issue certificates as provided by law; 31
(10) To keep in the superintendent's office at the capital of the 32
state, all books and papers pertaining to the business of the 33
superintendent's office, and to keep and preserve in the 34
superintendent's office a complete record of statistics, as well as a 35
record of the meetings of the state board of education;36
(11) With the assistance of the office of the attorney general, 37
to decide all points of law which may be submitted to the 38
superintendent in writing by any educational service district 39
superintendent, or that may be submitted to the superintendent by any 40

other person, upon appeal from the decision of any educational 1
service district superintendent; and the superintendent shall publish 2
his or her rulings and decisions from time to time for the 3
information of school officials and teachers; and the 4
superintendent's decision shall be final unless set aside by a court 5
of competent jurisdiction; 6
(12) To administer oaths and affirmations in the discharge of the 7
superintendent's official duties; 8
(13) To deliver to his or her successor, at the expiration of the 9
superintendent's term of office, all records, books, maps, documents 10
and papers of whatever kind belonging to the superintendent's office 11
or which may have been received by the superintendent's for the use 12
of the superintendent's office; 13
(14) To administer family services and programs to promote the 14
state's policy as provided in RCW 74.14A.025; 15
(15) To promote the adoption of school-based curricula and 16
policies that provide quality, daily physical education for all 17
students, and to encourage policies that provide all students with 18
opportunities for physical activity outside of formal physical 19
education classes; 20
(16) To ((perform all duties required by chapter 303, Laws of 21
2023 for the )) ensure the effective delivery and ((oversight)) 22
administration of basic education services to justice-involved 23
students ((under the age of 21 who are served through institutional 24
education programs in facilities that are not under the jurisdiction 25
of the department of social and health services or the department of 26
corrections)) and to improve their educational outcomes, both as 27
required by RCW 28A.190.150; and 28
(17) To perform such other duties as may be required by law.29
Sec. 2. RCW 28A.300.850 and 2023 c 303 s 4 are each amended to 30
read as follows: 31
(1)(a) The office of the superintendent of public instruction 32
shall develop a timeline and plan for assuming, by September 1, 33
((2027)) 2028, responsibility for the effective delivery and 34
administration of basic education services to justice-involved 35
students ((who are under the age of 21 and served through 36
institutional education programs in facilities that are not under the 37
jurisdiction of the department of social and health services or the 38
department of corrections)) and improving their educational outcomes.39

(b) The timeline and plan ((shall)) required by this section must 1
consider: 2
(i) The findings and recommendations produced in accordance with 3
section 2, chapter 303, Laws of 2023; ((recommendations))4
(ii) Recommendations provided in the December 1, 2022, improving 5
institutional education outcomes final report of the office of the 6
superintendent of public instruction and the department of children, 7
youth, and families; ((staffing transitions for educators and staff 8
that, as of July 23, 2023,))9
(iii) Staff that deliver education programming and services to 10
the justice-involved students; and ((legislation))11
(iv) Legislation enacted in 2024 and in subsequent years relating 12
to the superintendent's requirements under RCW 28A.190.150.13
(2) Beginning December 15, 2023, and annually thereafter through 14
((2026)) 2027, the office of the superintendent of public instruction 15
shall, in accordance with RCW 43.01.036, provide an interim report on 16
progress made in achieving the requirements of this section to the 17
governor and the education and fiscal committees of the legislature.18
(3) In meeting the requirements of this section, the office of 19
the superintendent of public instruction shall ((consult)):20
(a) Consult with organizations representing ((educators and staff 21
that deliver )) those who deliver, support, and receive education 22
programming and services to justice-involved students ((who are under 23
the age of 21 and served through institutional education programs in 24
facilities that are not under the jurisdiction of the department of 25
social and health services or the department of corrections));26
(b) Implement the research and analysis recommendations for the 27
two service delivery and governance options identified in the final 28
report required by section 2, chapter 303, Laws of 2023;29
(c) Examine an additional service delivery and governance option 30
that preserves the role of school districts in providing basic 31
education services to justice-involved youth, but includes additional 32
state direction in furtherance of the recommendations referenced in 33
subsection (1)(b)(ii) of this section and those provided in 34
accordance with section 2, chapter 226, Laws of 2020;35
(d) Describe how the office of the superintendent of public 36
instruction will ensure the effective delivery and administration of 37
basic education services to justice-involved students as required by 38
RCW 28A.190.150; and39

(e) Make recommendations for statutory or other changes needed to 1
ensure proper oversight of the delivery and administration of basic 2
education services.3
(4) For the purposes of this section, "justice-involved students" 4
has the same meaning as in RCW 28A.190.150. 5
(((4))) (5) This section expires June 30, ((2027)) 2028.6
Sec. 3. RCW 28A.190.150 and 2023 c 303 s 5 are each amended to 7
read as follows: 8
(1) Beginning September 1, ((2027)) 2028, the superintendent of 9
public instruction is responsible for ((the)) ensuring the effective 10
delivery and ((oversight)) administration of basic education services 11
to justice-involved students ((are who [who are] )) and improving the 12
educational outcomes of those students.13
(2) For the purposes of this section, "justice-involved students" 14
means students who are under the age of 21 , or as otherwise required 15
by law, and served through institutional education programs in 16
accordance with RCW 28A.150.200 in facilities that are not under the 17
jurisdiction of the department of social and health services or the 18
department of corrections. 19
(3) The office of the superintendent of public instruction shall 20
adopt, and periodically revise as necessary, rules to implement this 21
section.22
