AN ACT Relating to facilitating the prompt replacement of 1
defective continuous glucose monitoring equipment; and adding a new 2
section to chapter 18.64 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 18.64 5
RCW to read as follows: 6
(1) A pharmacy in a physical location that dispenses continuous 7
glucose monitoring equipment shall maintain a sufficient supply of 8
monitoring sensors to enable the pharmacy to provide a same-day 9
replacement sensor to a patient who experiences an equipment 10
malfunction or an emergency that necessitates an additional sensor to 11
be dispensed. 12
(2) A mail-order pharmacy that dispenses continuous glucose 13
monitoring equipment shall maintain a sufficient supply of monitoring 14
sensors to enable the pharmacy to promptly provide a replacement 15
sensor to a patient who experiences an equipment malfunction or an 16
emergency that necessitates an additional sensor to be dispensed. For 17
purposes of this subsection, "promptly" means mailing a replacement 18
sensor to the patient no later than the next business day or, if 19
