AN ACT Relating to protecting the sole authority of the 1
legislature to determine and make appropriations; and adding a new 2
section to chapter 4.92 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 4.92 RCW 5
to read as follows: 6
(1) The appropriation of state moneys is the sole duty of the 7
legislature, and the legislature has the sole authority to choose the 8
means of discharging any constitutional or statutory duty.9
(2) Pursuant to the legislature's sole authority to make 10
appropriations, entities or persons seeking declaratory relief, 11
injunctive relief, or any other judicial determination regarding 12
claims against the state for alleged violations of constitutional or 13
statutory duties or rights shall have no remedy that requires the 14
legislature to: 15
(a) Make appropriations or payments of state funds above levels 16
contained in any enacted omnibus budget; 17
(b) Redirect any appropriated or nonappropriated moneys; or18
