AN ACT Relating to hydraulic project approval mitigation after 1
natural events; amending RCW 77.55.261; and declaring an emergency.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 77.55.261 and 2005 c 146 s 604 are each amended to 4
read as follows: 5
(1) Whenever the placement of woody debris is required as a 6
condition of a permit issued under RCW 77.55.021, the department, 7
upon request, shall invite comment regarding that placement from the 8
local governmental authority, affected tribes, affected federal and 9
state agencies, and the project applicant. 10
(2) Whenever the placement of woody debris is required as a 11
condition of a permit issued under RCW 77.55.021 for work necessary 12
to respond to impacts from an extreme weather event or natural 13
disaster, the department must consider the following factors in 14
determining a reasonable placement amount and location in accordance 15
with RCW 77.55.231(1)(a):16
(a) The emergency nature of the work;17
(b) The extent to which urban development and the built 18
environment along the waterway may limit appropriate sites, access 19
to, or ownership of sites for woody debris placement;20
(c) Any potential increased risk of flooding;21

(d) Whether the placement increases the potential for 1
accumulation of debris that may create problematic log jams; and2
(e) The proportionate benefits to the protection of fish life 3
from:4
(i) Prioritizing substantial mitigation, rather than one-to-one 5
replacement, of woody debris removed from the waterway as part of the 6
immediate response to the event or disaster; and7
(ii) Limiting the maximum amount of required replacement to the 8
woody debris that originated from the initial occurrence, and not 9
subsequent accumulation.10
NEW SECTION. Sec. 2. This act is necessary for the immediate 11
preservation of the public peace, health, or safety, or support of 12
the state government and its existing public institutions, and takes 13
effect immediately.14
