AN ACT Relating to establishing criminal and civil penalties for 1
destruction of critical communications infrastructure; amending RCW 2
9A.82.010; reenacting and amending RCW 9.94A.515; adding new sections 3
to chapter 9A.56 RCW; and prescribing penalties. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
Sec. 1. RCW 9A.82.010 and 2024 c 301 s 27 are each amended to 6
read as follows: 7
Unless the context requires the contrary, the definitions in this 8
section apply throughout this chapter. 9
(1)(a) "Beneficial interest" means: 10
(i) The interest of a person as a beneficiary under a trust 11
established under Title 11 RCW in which the trustee for the trust 12
holds legal or record title to real property; 13
(ii) The interest of a person as a beneficiary under any other 14
trust arrangement under which a trustee holds legal or record title 15
to real property for the benefit of the beneficiary; or16
(iii) The interest of a person under any other form of express 17
fiduciary arrangement under which one person holds legal or record 18
title to real property for the benefit of the other person.19

(b) "Beneficial interest" does not include the interest of a 1
stockholder in a corporation or the interest of a partner in a 2
general partnership or limited partnership. 3
(c) A beneficial interest is considered to be located where the 4
real property owned by the trustee is located. 5
(2) "Control" means the possession of a sufficient interest to 6
permit substantial direction over the affairs of an enterprise.7
(3) "Creditor" means a person making an extension of credit or a 8
person claiming by, under, or through a person making an extension of 9
credit. 10
(4) "Criminal profiteering" means any act, including any 11
anticipatory or completed offense, committed for financial gain, that 12
is chargeable or indictable under the laws of the state in which the 13
act occurred and, if the act occurred in a state other than this 14
state, would be chargeable or indictable under the laws of this state 15
had the act occurred in this state and punishable as a felony and by 16
imprisonment for more than one year, regardless of whether the act is 17
charged or indicted, as any of the following: 18
(a) Murder, as defined in RCW 9A.32.030 and 9A.32.050;19
(b) Robbery, as defined in RCW 9A.56.200 and 9A.56.210;20
(c) Kidnapping, as defined in RCW 9A.40.020 and 9A.40.030;21
(d) Forgery, as defined in RCW 9A.60.020 and 9A.60.030;22
(e) Theft, as defined in RCW 9A.56.030, 9A.56.040, 9A.56.060, 23
9A.56.080, and 9A.56.083; 24
(f) Unlawful sale of subscription television services, as defined 25
in RCW 9A.56.230; 26
(g) Theft of telecommunication services or unlawful manufacture 27
of a telecommunication device, as defined in RCW 9A.56.262 and 28
9A.56.264; 29
(h) Child selling or child buying, as defined in RCW 9A.64.030;30
(i) Bribery, as defined in RCW 9A.68.010, 9A.68.020, 9A.68.040, 31
and 9A.68.050; 32
(j) Gambling, as defined in RCW 9.46.220 and 9.46.215 and 33

(uu) Trafficking in catalytic converters, as defined in RCW 19
9A.82.190 and 9A.82.200; or20
(vv) Destruction of critical communications infrastructure, as 21
defined in section 2 of this act. 22
(5) "Dealer in property" means a person who buys and sells 23
property as a business. 24
(6) "Debtor" means a person to whom an extension of credit is 25
made or a person who guarantees the repayment of an extension of 26
credit or in any manner undertakes to indemnify the creditor against 27
loss resulting from the failure of a person to whom an extension is 28
made to repay the same. 29
(7) "Documentary material" means any book, paper, document, 30
writing, drawing, graph, chart, photograph, phonograph record, 31
magnetic tape, computer printout, other data compilation from which 32
information can be obtained or from which information can be 33
translated into usable form, or other tangible item.34
(8) "Enterprise" includes any individual, sole proprietorship, 35
partnership, corporation, business trust, or other profit or 36
nonprofit legal entity, and includes any union, association, or group 37
of individuals associated in fact although not a legal entity, and 38
both illicit and licit enterprises and governmental and 39
nongovernmental entities. 40

(9) "Extortionate extension of credit" means an extension of 1
credit with respect to which it is the understanding of the creditor 2
and the debtor at the time the extension is made that delay in making 3
repayment or failure to make repayment could result in the use of 4
violence or other criminal means to cause harm to the person, 5
reputation, or property of any person. 6
(10) "Extortionate means" means the use, or an express or 7
implicit threat of use, of violence or other criminal means to cause 8
harm to the person, reputation, or property of any person.9
(11) "Financial institution" means any bank, trust company, 10
savings and loan association, savings bank, mutual savings bank, 11
credit union, or loan company under the jurisdiction of the state or 12
an agency of the United States. 13
(12) "Pattern of criminal profiteering activity" means engaging 14
in at least three acts of criminal profiteering, one of which 15
occurred after July 1, 1985, and the last of which occurred within 16
five years, excluding any period of imprisonment, after the 17
commission of the earliest act of criminal profiteering. In order to 18
constitute a pattern, the three acts must have the same or similar 19
intent, results, accomplices, principals, victims, or methods of 20
commission, or be otherwise interrelated by distinguishing 21
characteristics including a nexus to the same enterprise, and must 22
not be isolated events. However, in any civil proceedings brought 23
pursuant to RCW 9A.82.100 by any person other than the attorney 24
general or county prosecuting attorney in which one or more acts of 25
fraud in the purchase or sale of securities are asserted as acts of 26
criminal profiteering activity, it is a condition to civil liability 27
under RCW 9A.82.100 that the defendant has been convicted in a 28
criminal proceeding of fraud in the purchase or sale of securities 29
under RCW 21.20.400 or under the laws of another state or of the 30
United States requiring the same elements of proof, but such 31
conviction need not relate to any act or acts asserted as acts of 32
criminal profiteering activity in such civil action under RCW 33
9A.82.100. 34
(13) "Real property" means any real property or interest in real 35
property, including but not limited to a land sale contract, lease, 36
or mortgage of real property. 37
(14) "Records" means any book, paper, writing, record, computer 38
program, or other material. 39

(15) "Repayment of an extension of credit" means the repayment, 1
satisfaction, or discharge in whole or in part of a debt or claim, 2
acknowledged or disputed, valid or invalid, resulting from or in 3
connection with that extension of credit. 4
(16) "Stolen property" means property that has been obtained by 5
theft, robbery, or extortion. 6
(17) "To collect an extension of credit" means to induce in any 7
way a person to make repayment thereof. 8
(18) "To extend credit" means to make or renew a loan or to enter 9
into an agreement, tacit or express, whereby the repayment or 10
satisfaction of a debt or claim, whether acknowledged or disputed, 11
valid or invalid, and however arising, may or shall be deferred.12
(19) "Traffic" means to sell, transfer, distribute, dispense, or 13
otherwise dispose of stolen property to another person, or to buy, 14
receive, possess, or obtain control of stolen property, with intent 15
to sell, transfer, distribute, dispense, or otherwise dispose of the 16
property to another person. 17
(20)(a) "Trustee" means: 18
(i) A person acting as a trustee under a trust established under 19
Title 11 RCW in which the trustee holds legal or record title to real 20
property; 21
(ii) A person who holds legal or record title to real property in 22
which another person has a beneficial interest; or23
(iii) A successor trustee to a person who is a trustee under 24
(a)(i) or (ii) of this subsection. 25
(b) "Trustee" does not mean a person appointed or acting as:26
(i) A personal representative under Title 11 RCW;27
(ii) A trustee of any testamentary trust; 28
(iii) A trustee of any indenture of trust under which a bond is 29
issued; or 30
(iv) A trustee under a deed of trust. 31
(21) "Unlawful debt" means any money or other thing of value 32
constituting principal or interest of a debt that is legally 33
unenforceable in the state in full or in part because the debt was 34
incurred or contracted: 35
(a) In violation of any one of the following: 36
(i) Chapter 67.16 RCW relating to horse racing;37
(ii) Chapter 9.46 RCW relating to gambling; 38
(b) In a gambling activity in violation of federal law; or39

(c) In connection with the business of lending money or a thing 1
of value at a rate that is at least twice the permitted rate under 2
the applicable state or federal law relating to usury.3
NEW SECTION. Sec. 2. A new section is added to chapter 9A.56 4
RCW to read as follows: 5
(1) A person is guilty of destruction of critical communications 6
infrastructure if, with intent to cause damage, commit theft, or 7
cause harm to communications infrastructure including both physical 8
and cyber components that deliver voice, video, and data services, 9
causes damage to or renders inoperable such voice, video, or data 10
services. 11
(2) Destruction of critical communications infrastructure is a 12
class C felony. 13
NEW SECTION. Sec. 3. A new section is added to chapter 9A.56 14
RCW to read as follows: 15
(1) In addition to the criminal penalties provided in section 2 16
of this act, there is created a civil cause of action for destruction 17
of critical communications infrastructure. 18
(2) A person who sustains injury to his or her person, business, 19
or property by an act described in section 2 of this act may file an 20
action in superior court against the perpetrator for the recovery of 21
damages and the costs of the suit, including reasonable investigative 22
and attorneys' fees and costs. 23
Sec. 4. RCW 9.94A.515 and 2024 c 301 s 29 and 2024 c 55 s 1 are 24
each reenacted and amended to read as follows: 25
