AN ACT Relating to enforcement actions for property damage of 1
electric vehicle charging stations; adding a new section to chapter 2
46.61 RCW; and prescribing penalties. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 46.61 5
RCW to read as follows: 6
(1) It is a violation of this section if a person with criminal 7
intent causes an interruption or impairment of service of an electric 8
vehicle charging station through cutting wires, damaging or tampering 9
with its operation, or stealing it, to be punished in the following 10
manner: 11
(a) If the electric vehicle charging station and related 12
supporting infrastructure is less than $1,000 in value, the violation 13
is a gross misdemeanor; 14
(b) If the electric vehicle charging station and related 15
supporting infrastructure is $1,000 to $5,000 in value, the violation 16
is a class C felony; or 17
(c) If the electric vehicle charging station and related 18
supporting infrastructure is more than $5,000 in value, the violation 19
is a class B felony. 20

(2) The crimes in subsection (1) of this section are not intended 1
to apply to any person working for an electricity service provider 2
that inadvertently causes interruption or impairment of service or 3
physical harm to the electric vehicle charging station.4
(3) A person who violates this section, upon conviction, in 5
addition to any other punishment or penalty, shall be ordered to make 6
restitution to the owner or operator of the electric vehicle charging 7
station or any other related costs as authorized in RCW 9.94A.750.8
(4) When a person is found to be in violation of this section, 9
there must be assessed an additional fine of $100 to be deposited 10
into the multimodal transportation account created in RCW 47.66.070 11
if the violation occurred on state property or in the county road 12
fund authorized in RCW 36.82.020 of the county where the violation 13
occurred. 14
(5) A person who has been deprived of an operational electric 15
vehicle charging station in accordance with subsection (1) of this 16
section may file an action in superior court against the perpetrator 17
for the recovery of actual damages, limited to the value of any 18
damage to the electric vehicle charging station and any 19
infrastructure attached to the electric vehicle charging station, 20
civil damages up to $5,000, and the costs of the suit, including 21
reasonable attorneys' fees. 22
(6) For purposes of this section, "electric vehicle charging 23
station" means a station that delivers electricity from a source 24
outside an electric vehicle into one or more electric vehicles. An 25
electric vehicle charging station may include several charge points 26
simultaneously connecting several electric vehicles to the station 27
and any related equipment needed to facilitate charging plug-in 28
electric vehicles, such as electric vehicle supply equipment capable 29
of sending commands, payments, or messages remotely from or to an 30
electric vehicle service provider as part of an electric vehicle's 31
charging process. 32
