AN ACT Relating to K-12 savings and efficiencies; amending RCW 1
28A.510.250 and 28A.500.015; and providing effective dates.2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 28A.510.250 and 2017 3rd sp.s. c 13 s 1004 are each 4
amended to read as follows: 5
(1) On or before the last business day of September 1969 and each 6
month thereafter, the superintendent of public instruction shall 7
apportion from the state general fund to the several educational 8
service districts of the state the proportional share of the total 9
annual amount due and apportionable to such educational service 10
districts for the school districts thereof as follows:11

The annual amount due and apportionable shall be the amount 5
apportionable for all apportionment credits estimated to accrue to 6
the schools during the apportionment year beginning September 1st and 7
continuing through August 31st. Appropriations made for school 8
districts for each year of a biennium shall be apportioned according 9
to the schedule set forth in this section for the fiscal year 10
starting September 1st of the then calendar year and ending August 11
31st of the next calendar year, except as provided in subsection (2) 12
of this section. The apportionment from the state general fund for 13
each month shall be an amount which will equal the amount due and 14
apportionable to the several educational service districts during 15
such month: PROVIDED, That any school district may petition the 16
superintendent of public instruction for an emergency advance of 17
funds which may become apportionable to it but not to exceed ten 18
percent of the total amount to become due and apportionable during 19
the school districts apportionment year. The superintendent of public 20
instruction shall determine if the emergency warrants such advance 21
and if the funds are available therefor. If the superintendent 22
determines in the affirmative, he or she may approve such advance 23
and, at the same time, add such an amount to the apportionment for 24
the educational service district in which the school district is 25
located: PROVIDED, That the emergency advance of funds and the 26
interest earned by school districts on the investment of temporary 27
cash surpluses resulting from obtaining such advance of state funds 28
shall be deducted by the superintendent of public instruction from 29
the remaining amount apportionable to said districts during that 30
apportionment year in which the funds are advanced.31
(2) ((In the 2010-11 school year, the June apportionment payment 32
to school districts shall be reduced by one hundred twenty-eight 33
million dollars, and an additional apportionment payment shall be 34
made on July 1, 2011, in the amount of one hundred twenty-eight 35
million dollars. This July 1st payment shall be in addition to the 36
regularly calculated July apportionment payment. )) For the 2025-26 37
and 2026-27 school years, the appropriations made for school 38
districts shall be apportioned according to the schedule set forth in 39

subsection (1) of this section, except the following months will be 1

Sec. 2. RCW 28A.500.015 and 2022 c 108 s 4 are each amended to 7
read as follows: 8
(1) Beginning in calendar year 2020 and each calendar year 9
thereafter, the state must provide state local effort assistance 10
funding to supplement school district enrichment levies as provided 11
in this section. 12
(2)(a) For an eligible school district with an actual enrichment 13
levy rate that is less than ((one dollar and fifty cents )) $1.50 per 14
((thousand dollars)) $1,000 of assessed value in the school district, 15
the annual local effort assistance funding is equal to the school 16
district's maximum local effort assistance multiplied by a fraction 17
equal to the school district's actual enrichment levy rate divided by 18
((one dollar and fifty cents )) $1.50 per ((thousand dollars)) $1,000 19
of assessed value in the school district. 20
(b) For an eligible school district with an actual enrichment 21
levy rate that is equal to or greater than ((one dollar and fifty 22
cents)) $1.50 per ((thousand dollars )) $1,000 of assessed value in 23
the school district, the annual local effort assistance funding is 24
equal to the school district's maximum local effort assistance.25
(c) Beginning in calendar year 2022, for state-tribal education 26
compact schools established under chapter 28A.715 RCW, the annual 27
local effort assistance funding is equal to the actual enrichment 28
levy per student as calculated by the superintendent of public 29
instruction for the previous year for the school district in which 30
the state-tribal education compact school is located, up to a maximum 31
per student amount of ((one thousand five hundred fifty dollars )) 32
$1,550 as increased by inflation from the 2019 calendar year, 33
multiplied by the student enrollment of the state-tribal education 34
compact school in the prior school year. 35
(3) The state local effort assistance funding provided under this 36
section is not part of the state's program of basic education deemed 37

by the legislature to comply with the requirements of Article IX, 1
section 1 of the state Constitution. 2
(4) The definitions in this subsection apply throughout this 3
section unless the context clearly requires otherwise.4
(a) "Eligible school district" means a school district where the 5
amount generated by a levy of ((one dollar and fifty cents )) $1.50 6
per ((thousand dollars )) $1,000 of assessed value in the school 7
district, divided by the school district's total student enrollment 8
in the prior school year, is less than the state local effort 9
assistance threshold. 10
(b) ((For the purpose of this section, "inflation" )) "Inflation" 11
means, for any school year, the rate of the yearly increase of the 12
previous calendar year's annual average consumer price index for all 13
urban consumers, Seattle area, using the official current base 14
compiled by the bureau of labor statistics, United States department 15
of labor. 16
(c) "Maximum local effort assistance" means the difference 17
between the following: 18
(i) The school district's actual prior school year enrollment 19
multiplied by the state local effort assistance threshold; and20
(ii) The amount generated by a levy of ((one dollar and fifty 21
cents)) $1.50 per ((thousand dollars )) $1,000 of assessed value in 22
the school district. 23
(d) "Prior school year" means the most recent school year 24
completed prior to the year in which the state local effort 25
assistance funding is to be distributed((, except as follows:26
(i) In the 2022 calendar year, if 2019-20 school year average 27
annual full-time equivalent enrollment is greater than the school 28
district's 2020-21 school year average annual full-time equivalent 29
enrollment, "prior school year" means the 2019-20 school year.30
(ii) In the 2023 calendar year, if 2019-20 school year average 31
annual full-time equivalent enrollment is greater than the school 32
district's 2021-22 school year average annual full-time equivalent 33
enrollment, "prior school year" means the 2019-20 school year)).34
(e) "State local effort assistance threshold" means ((one 35
thousand five hundred fifty dollars )) $1,550 per student, increased 36
for inflation beginning in calendar year 2020. 37
(f) "Student enrollment" means the average annual full-time 38
equivalent student enrollment , reduced by the alternative learning 39
experience adjustment. Alternative learning experience adjustment 40

equals (f)(i) of this subsection minus (f)(ii) of this subsection if 1
a school district's full-time equivalent student enrollment in 2
alternative learning experience courses exceeds 33 percent of average 3
annual full-time equivalent student enrollment. 4
(i) The full-time equivalent students enrolled in an alternative 5
learning experience course.6
(ii) Average annual full-time equivalent student enrollment 7
multiplied by 33 percent. 8
(5) For districts in a high/nonhigh relationship, the enrollments 9
of the nonhigh students attending the high school shall only be 10
counted by the nonhigh school districts for purposes of funding under 11
this section. 12
(6) For school districts participating in an innovation academy 13
cooperative established under RCW 28A.340.080, enrollments of 14
students attending the academy shall be adjusted so that each 15
participant district receives its proportional share of student 16
enrollments for purposes of funding under this section.17
NEW SECTION. Sec. 3. Section 1 of this act takes effect 18
September 1, 2025.19
NEW SECTION. Sec. 4. Section 2 of this act takes effect January 20
1, 2026.21
