AN ACT Relating to requiring certain disclosures from private 1
entities that receive state funding; and adding a new chapter to 2
Title 19 RCW. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. (1) All private entities that receive, 5
either as a grantee or a subgrantee, a grant that is funded in whole 6
or in part by state funds must disclose on its website or other 7
publicly accessible means the following information within five 8
business days of being awarded the grant:9
(a) The name of each employee of the private entity and wages 10
paid to each employee; 11
(b) The name of each board member of the private entity and any 12
compensation paid to each board member; 13
(c) Any political contributions made by the private entity in the 14
previous four election cycles; 15
(d) The name of any lobbyist who is either employed with the 16
private entity or who the private entity has contracted with for 17
lobbying services; and 18
(e) An accounting of how the grant money was spent by the private 19
entity. 20

(2) Any agency that awards, either directly or as pass-through 1
funding, a grant that is funded in whole or in part by state funds 2
shall ensure that grantees and subgrantees are in compliance with 3
subsection (1) of this section. Noncompliance with subsection (1) of 4
this section must result in a forfeit of the award and the 5
noncompliant private entity shall reimburse the grantor the complete 6
amount of the funds awarded. 7
(3) The following definitions apply to this section:8
(a)(i) "Agency" includes all state agencies and all local 9
agencies. 10
(ii) "State agency" includes every state office, department, 11
division, bureau, board, commission, or other state agency.12
(iii) "Local agency" includes every county, city, town, municipal 13
corporation, quasi-municipal corporation, or special purpose 14
district, or any office, department, division, bureau, board, 15
commission, or agency thereof, or other local public agency.16
(b) "Grant" does not include a business transaction for the 17
procurement of goods and services, as those terms are defined in RCW 18
39.26.010. 19
(c) "Private entity" means any nonpublic individual firm, 20
corporation, association, partnership, consortium, joint venture, 21
nonprofit organization, and any other nonpublic entity.22
NEW SECTION. Sec. 2. Section 1 of this act constitutes a new 23
chapter in Title 19 RCW.24
