AN ACT Relating to prohibiting elected officials and their 1
spouses from holding employment or any beneficial interest in private 2
entities; and adding a new section to chapter 42.52 RCW.3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:4
NEW SECTION. Sec. 1. A new section is added to chapter 42.52 5
RCW to read as follows: 6
(1) Except as provided in subsection (2) of this section, no 7
elected official or the spouse of an elected official may be employed 8
at a private entity, enter a contract with a private entity, be paid 9
for services provided to a private entity, or have any other direct 10
or indirect beneficial interest in a private entity, if that private 11
entity receives state funding. 12
(2) Subsection (1) of this section does not prohibit employment 13
at a public agency. 14
(3) Regardless of the definitions in RCW 42.52.010, the following 15
definitions apply to this section: 16
(a) "Agency" includes all state agencies and all local agencies. 17
"State agency" includes every state office, department, division, 18
bureau, board, commission, or other state agency. "Local agency" 19
includes every county, city, town, municipal corporation, quasi-20
municipal corporation, or special purpose district, or any office, 21

(b) "Beneficial interest" means a financial interest or the right 3
to enjoy profit, benefit, or advantage from any contract, loan 4
agreement, property, or other transaction or business of or with a 5
private entity. 6
(c) "Elected official" means any person elected at a general or 7
special election to any public office, and any person appointed to 8
fill a vacancy in any such office. 9
(d) "Private entity" means any nonpublic individual firm, 10
corporation, association, partnership, consortium, joint venture, 11
nonprofit organization, and any other nonpublic entity.12
