AN ACT Relating to applications for state financial aid; and 1
adding a new section to chapter 28B.77 RCW. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
NEW SECTION. Sec. 1. A new section is added to chapter 28B.77 4
RCW to read as follows: 5
(1) Any personally identifying information or financial 6
information related to an application for state financial aid is 7
exempt from public inspection and copying under chapter 42.56 RCW.8
(2) Records of applicants to any alternative application for 9
state financial aid for postsecondary education approved by the 10
council, and related records, including student numbers assigned by 11
the council, must be held for a period of no longer than one year 12
following the end of a postsecondary institution's award year, absent 13
an outstanding audit or appeal regarding the award of aid and unless 14
otherwise required by law. 15
(3)(a) No state agency may provide information described in 16
subsection (1) of this section to any other entity, including the 17
federal government, absent a court order. 18
(b) The prohibition in (a) of this subsection does not apply to 19
information described in subsection (1) of this section shared 20

between the council and institutions of higher education for the 1
purpose of supporting or facilitating student enrollment.2
(4) The council and institutions of higher education may not, 3
absent a court order, disclose or reproduce records described in 4
subsection (2) of this section to any other entity, including the 5
federal government, unless required to comply with state or federal 6
law, or in response to a lawfully issued court order.7
(5) For purposes of this section, "application for state 8
financial aid" means any other alternative application for state 9
financial aid for postsecondary education approved by the council, 10
excluding the free application for federal student aid.11
