AN ACT Relating to increasing access to data related to the 1
safety and stability of residential settings for individuals with 2
developmental disabilities; adding a new section to chapter 71A.12 3
RCW; and creating new sections. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:5
NEW SECTION. Sec. 1. (1) The legislature finds that the state 6
uses a mixed-delivery model for developmental disability services, 7
relying on both state-operated facilities and placements and 8
contracted private providers.9
(2) The legislature further finds that reliable data regarding 10
client safety, stability, and law enforcement interaction is well-11
documented within state-operated facilities but lacks standardization 12
across the network of private vendors. 13
(3) The legislature intends to conduct a review of recent data 14
and establish an ongoing data dashboard to ensure that taxpayers and 15
families have access to an honest, apples-to-apples comparison of 16
safety and stability outcomes across all residential service 17
settings. 18
NEW SECTION. Sec. 2. (1) The joint legislative audit and review 19
committee shall conduct a review of safety and stability outcomes 20

across the department of social and health services developmental 1
disabilities residential services continuum, as provided in this 2
section. 3
(2) The review must aggregate and compare data as described in 4
subsections (3) and (4) of this section from the following settings 5
for the period of January 1, 2022, through December 31, 2025:6
(a) Residential habilitation centers; 7
(b) State-operated living alternatives; and 8
(c) Contracted community-based residential settings, including 9
group homes, group training homes, residential supported living, 10
companion homes, and other similar settings. 11
(3) For each setting, the review must include the following 12
information, per calendar year, for clients assessed by the 13
department of social and health services as having a high behavior 14
acuity level, a high medical acuity level, or both, according to the 15
developmental disabilities assessment: 16
(a) The number of calls to 911 due to client behavioral 17
management needs or crisis intervention; 18
(b) The number of emergency room visits where the client was 19
medically cleared for discharge but remained in the hospital due to 20
lack of an available provider acceptance based in full or in part on 21
behavioral or safety concerns; and 22
(c) The number of instances where a client's residential 23
placement was terminated due to the client's behavioral challenges, 24
resulting in a transfer to state custody, incarceration, or 25
homelessness. 26
(4) The review must also include the following information for 27
each setting identified in subsection (2) of this section:28
(a) The annual census of high behavioral or medical acuity 29
clients in each setting, and the percentage of the overall client 30
census that these clients represent for each setting; and31
(b) A comparison of staff retention rates across each setting.32
(5) By December 1, 2026, and in compliance with RCW 43.01.036, 33
the joint legislative audit and review committee shall compile its 34
review findings into a report to the legislature. 35
NEW SECTION. Sec. 3. A new section is added to chapter 71A.12 36
RCW to read as follows: 37
(1) By June 1, 2027, the department shall establish a public-38
facing provider safety and stability dashboard on its website to 39

allow families, guardians, and other members of the public to view 1
aggregate data on emergency service utilization and placement 2
stability for contracted residential settings as compared to state-3
operated residential settings for department clients with 4
developmental disabilities. 5
(2) Initial data for the dashboard must utilize the findings of 6
the report required under section 2 of this act. The department shall 7
collect the necessary data to update the dashboard. The first update 8
must be completed by December 1, 2027, and must include updated data 9
starting from January 1, 2026. The dashboard must be updated on an 10
annual basis thereafter with updates completed by December 1st of 11
each year. 12
