AN ACT Relating to warehousing of alcohol; and amending RCW 1
66.24.185. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:3
Sec. 1. RCW 66.24.185 and 2025 c 343 s 13 are each amended to 4
read as follows: 5
(1) There shall be a license for bonded wine warehouses , which 6
shall authorize the storage and handling of bottled wine , and a 7
license for bonded beer warehouses, which shall authorize the storage 8
and handling of bottled, canned, and kegged beer including strong 9
beer. Under ((this)) the bonded wine warehouse license a licensee may 10
maintain a warehouse for the storage of wine off the premises of a 11
winery or wine distributor. Under the bonded beer warehouse license a 12
licensee may maintain a warehouse for the storage of beer including 13
strong beer off the premises of a microbrewery, domestic brewery, or 14
beer distributor.15
(2) The board shall adopt similar qualifications for a bonded 16
wine warehouse license as required for obtaining a domestic winery 17
license as specified in RCW 66.24.010 and 66.24.170 and, for a bonded 18
beer warehouse license, as required for obtaining a microbrewery 19
license or domestic brewery license as specified in RCW 66.24.010, 20
66.24.244, and 66.24.240. A licensee must be a sole proprietor, a 21

partnership, a limited liability company, or a corporation. One or 1
more domestic wineries may operate as a partnership, corporation, 2
business co-op, or agricultural co-op for the purposes of obtaining a 3
bonded wine warehouse license. One or more microbreweries and 4
domestic breweries may operate as a partnership, corporation, 5
business co-op, or agricultural co-op for the purpose of obtaining a 6
bonded beer warehouse license.7
(3)(a) All bottled wine shipped to a bonded wine warehouse from a 8
winery or another bonded wine warehouse shall remain under bond and 9
no tax imposed under RCW 66.24.210 shall be due, unless the wine is 10
removed from bond and shipped to a licensed Washington wine 11
distributor or to a consumer . Wine may be removed from a bonded wine 12
warehouse only for the purpose of being (((a))) (i) exported from the 13
state, (((b))) (ii) shipped to a licensed Washington wine 14
distributor, (((c))) (iii) returned to a winery or bonded wine 15
warehouse, or (((d))) (iv) shipped to a consumer pursuant to RCW 16
66.20.360 through 66.20.390. 17
(b) All bottled, canned, and kegged beer including strong beer 18
shipped to a bonded beer warehouse from a microbrewery, domestic 19
brewery, or another bonded beer warehouse shall remain under bond and 20
no tax imposed under RCW 66.24.290 shall be due, unless the beer is 21
removed from bond and shipped to a licensed Washington beer 22
distributor or to a consumer. Beer including strong beer may be 23
removed from a bonded beer warehouse only for the purpose of being 24
(i) exported from the state, (ii) shipped to a licensed Washington 25
beer distributor, (iii) returned to a microbrewery, domestic brewery, 26
or bonded beer warehouse, or (iv) shipped to a consumer pursuant to 27
rules of the board.28
(4)(a) Warehousing of wine by any person other than (((a))) (i) a 29
licensed domestic winery or a bonded wine warehouse licensed under 30
the provisions of this section, (((b))) (ii) a licensed Washington 31
wine distributor, (((c))) (iii) a licensed Washington wine importer, 32
(((d))) or (iv) a wine certificate of approval holder (W7), ((or (e) 33
the board,)) is prohibited. 34
(b) Warehousing of beer including strong beer by any person other 35
than (i) a licensed microbrewery, domestic brewery, or bonded beer 36
warehouse under the provisions of this section, (ii) a licensed 37
Washington beer distributor, (iii) a licensed Washington beer 38
importer, or (iv) a beer certificate of approval holder, is 39
prohibited.40

(5) ((A)) (a) To warehouse wine, a license applicant shall hold a 1
federal permit for a bonded wine cellar and may be required to post a 2
continuing wine tax bond of such an amount and in such a form as may 3
be required by the board prior to the issuance of a bonded wine 4
warehouse license. The fee for this license shall be $150 per annum , 5
unless an applicant is already licensed under (b) of this subsection 6
in which case there is no additional annual fee under this subsection 7
(5)(a). 8
(b) To warehouse beer including strong beer, a license applicant 9
shall hold a federal permit or authorization for the activity as 10
specified by the board and may be required to post a continuing beer 11
tax bond of such an amount and in such a form as may be required by 12
the board prior to the issuance of a bonded beer warehouse license. 13
The fee for this license shall be $150 per annum, unless an applicant 14
is already licensed under (a) of this subsection in which case there 15
is no additional annual fee under this subsection (5)(b).16
(6)(a) The board shall adopt rules requiring a bonded wine 17
warehouse and a bonded beer warehouse to be physically secure, zoned 18
for the intended use , and, except as provided in (b) of this 19
subsection, physically separated from any other use.20
(b)(i) A person holding both a bonded wine warehouse license and 21
a bonded beer warehouse license may store and handle bottled wine, 22
bottled, canned, and kegged beer, including strong beer, and 23
nonalcohol materials, in the same area of the premises.24
(ii) Nonalcohol materials may be stored and handled in the same 25
area of the premises as wine by a bonded wine warehouse licensee and 26
in the same area of the premises as beer, including strong beer, by a 27
bonded beer warehouse licensee.28
(iii) Nothing in this section prohibits a licensed bonded wine 29
warehouse or a licensed bonded beer warehouse from allowing customers 30
to access any areas of the premises.31
(7) Every licensee shall submit to the board a monthly report of 32
movement of bottled wines to and from a bonded wine warehouse and of 33
bottled, canned, and kegged beer including strong beer to and from a 34
bonded beer warehouse in a form prescribed by the board. The board 35
may adopt other necessary procedures by which bonded wine warehouses 36
and bonded beer warehouses are licensed and regulated.37
(8)(a) Handling of bottled wine, as provided for in this section, 38
includes packaging and repackaging services; bottle labeling 39
services; creating baskets or variety packs that may or may not 40

include nonwine products; and picking, packing, and shipping wine 1
orders direct to consumer. A winery contracting with a bonded wine 2
warehouse for handling bottled wine must comply with all applicable 3
state and federal laws and shall be responsible for financial 4
transactions in direct to consumer shipping activities.5
(b) Handling of bottled, canned, and kegged beer including strong 6
beer, as provided for in this section, includes packaging and 7
repackaging services; labeling services; creating baskets or variety 8
packs that may or may not include nonbeer products; and picking, 9
packing, and shipping beer and strong beer orders direct to consumer. 10
A microbrewery or domestic brewery contracting with a bonded beer 11
warehouse for handling bottled, canned, and kegged beer including 12
strong beer must comply with all applicable state and federal laws 13
and shall be responsible for financial transactions in direct to 14
consumer shipping activities.15
