AN ACT Relating to wildfire prevention and creating the 1
Washington wildfire prevention and protection council; amending RCW 2
76.04.185 and 80.28.445; reenacting and amending RCW 43.84.092, 3
43.84.092, 43.84.092, 43.84.092, 43.84.092, and 43.84.092; adding a 4
new chapter to Title 76 RCW; providing effective dates; providing a 5
contingent effective date; providing expiration dates; and providing 6
contingent expiration dates. 7
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:8
NEW SECTION. Sec. 1. (1) The legislature finds that the 9
increased cost of catastrophic wildfires poses an immediate and 10
growing threat to communities, infrastructure, and property in all 11
regions of Washington state. Changing climate conditions and 12
development patterns in the wildland urban interface increases both 13
the likelihood and severity of wildfires capable of consuming entire 14
communities in a single event.15
(2) The legislature further finds that the state must enact 16
policies that both mitigate wildfire risk and prepare Washington to 17
respond effectively when catastrophic wildfires occur. The scale and 18
speed of modern wildfire events require proactive planning, financial 19
readiness, and coordinated oversight to protect lives, property, 20
and essential public systems. 21

(3) The legislature recognizes that a wildfire prevention and 1
protection fund can support both objectives. Such a fund can provide 2
justice for wildfire victims by creating a reliable 3
and timely pathway to compensation when catastrophic losses occur. 4
The legislature finds that victims of catastrophic wildfires are 5
diverse and include tribal governments, local governments, timberland 6
owners, homeowners, renters, and small businesses; many of whom lose 7
not only property but housing, livelihoods, and community stability. 8
All stand to benefit from the existence of a predictable, well-9
structured fund. 10
(4) The legislature further finds that the fund should also 11
support wildfire mitigation, prevention, and resilience efforts. 12
Investment revenue generated by the fund may be used to restore 13
forest health, reduce hazardous fuels, and help vulnerable 14
communities harden through measures such as forest health practices 15
and vegetation management, defensible space, and removal of burnable 16
material around homes and critical infrastructure. These investments 17
reduce future wildfire risk and lessen the severity of catastrophic 18
events. 19
(5) The legislature acknowledges that electric utilities are not 20
the sole cause of wildfires, but utility-related ignitions can result 21
in some of the most destructive and costly wildfire events. 22
The magnitude of potential liability from such events threatens 23
utility solvency, destabilizes insurance markets, increases costs for 24
consumers, and jeopardizes the reliability of essential energy 25
infrastructure. The legislature therefore intends that the fund also 26
supports utility financial stability, protects ratepayers from 27
extreme cost shocks, and helps maintain affordable 28
and reliable service for Washington consumers. 29
(6) The legislature further finds that Washington cannot rely 30
solely on the federal government to respond to catastrophic wildfires 31
that destroy entire communities. Federal assistance may be delayed or 32
insufficient to address the full scope of losses experienced by 33
victims and local governments. The state must establish its own 34
capacity to respond decisively to catastrophic events.35
(7) The legislature therefore intends to establish a wildfire 36
prevention and protection fund as part of a comprehensive 37
wildfire resilience strategy that: 38
(a) Provides timely and equitable compensation to victims of 39
catastrophic wildfires; 40

(b) Supports mitigation, prevention, and infrastructure hardening 1
to reduce future wildfire risk; 2
(c) Preserves the financial stability of essential utilities and 3
protects consumers from excessive rate and insurance impacts; and4
(d) Creates a flexible framework capable of evolving as wildfire 5
risk, climate conditions, and best practices change over time.6
(8) The legislature further intends to establish a wildfire 7
protection and prevention council to oversee the fund, guide 8
investment and mitigation priorities, and take other necessary 9
actions to protect the state from wildfire risk. The council shall 10
promote accountability, transparency, and coordination across 11
agencies, utilities, local governments, tribes, and 12
affected communities. By establishing this framework, the legislature 13
takes a measured and forward-looking step to address the reality of 14
catastrophic wildfire risk while advancing justice for victims, 15
strengthening prevention and mitigation efforts, protecting 16
consumers, and safeguarding Washington's long-term economic and 17
environmental health. 18
NEW SECTION. Sec. 2. The definitions in this section apply 19
throughout this chapter unless the context clearly requires 20
otherwise.21
(1) "Administrator" means the fund administrator selected by the 22
commission. 23
(2) "Consumer-owned utility" has the same meaning as in RCW 24
19.29A.010. 25
(3) "Council" means the Washington wildfire prevention and 26
protection council. 27
(4) "Covered wildfire" means any wildfire that is caused by an 28
electric utility's negligence. 29
(5) "Department" means the department of natural resources, or 30
its authorized representatives, as defined in chapter 43.30 RCW.31
(6) "Electric utility" means an electrical company or a consumer-32
owned utility. 33
(7) "Electrical company" has the same meaning as in RCW 34
80.04.010. 35
(8) "Fund" means the wildfire prevention and protection fund.36
(9) "Fund contribution" means a one-time payment to be made by 37
each electrical company to the fund. 38

(10) "High risk customer" means an electric utility customer in a 1
service territory that has been designated by the department under 2
RCW 43.30.580 or by the United States forest service as having a high 3
wildfire hazard potential. 4
(11) "Participating electric utility" means an electric utility 5
that has satisfied the eligibility requirements of the fund.6
(12) "Wildfire fund annual contribution" means the annual 7
contribution that participating electric utilities must pay to the 8
administrator for deposit in the fund. 9
NEW SECTION. Sec. 3. (1) The Washington wildfire prevention and 10
protection council is established to implement and administer the 11
fund. The council's primary responsibilities consist of:12
(a) Oversight and guidance of the fund; 13
(b) Selecting and directing an administrator for the fund to 14
oversee operations; 15
(c) Setting and collecting a fund contribution that would 16
establish a balance sufficient to implement and administer the fund 17
through the first full fiscal year of operation; 18
(d) Setting and collecting the wildfire surcharge for 19
participating electric utilities under section 4(3) of this act;20
(e) Providing recommendations to the legislature on the structure 21
of the fund and any potential improvements, as appropriate.22
(2) The council shall consist of 15 members and be comprised of 23
the following members: 24
(a) One representative from each of the following:25
(i) The department, appointed by the commissioner of public 26
lands; 27
(ii) The utilities and transportation commission, appointed by 28
the chair of the utilities and transportation commission;29
(iii) The office of the insurance commissioner, appointed by the 30
insurance commissioner; 31
(iv) The office of the state treasurer, appointed by the state 32
treasurer; 33
(v) The office of the governor, appointed by the governor;34
(vi) Tribal governments, appointed by the board of natural 35
resources; 36
(vii) The energy resilience and emergency management office of 37
the department of commerce, appointed by the director of the 38
department of commerce; 39

(viii) Investor-owned utilities, appointed by the board of 1
natural resources; 2
(ix) Rural electric cooperatives, appointed by the board of 3
natural resources; 4
(x) Public utility districts, appointed by the board of natural 5
resources; and 6
(xi) The public, appointed by the board of natural resources;7
(b) Two members from the senate, with one member appointed from 8
each of the two largest caucuses in the senate by the president of 9
the senate; and 10
(c) Two members from the house of representatives, with one 11
member appointed from each of the two largest caucuses in the house 12
of representatives by the speaker of the house. 13
(3) The members of the council shall select a chair and vice 14
chair from the members representing a state agency or tribal 15
government. 16
(4) The members of the council may receive reimbursement for 17
travel expenses in accordance with RCW 43.03.050 and 43.03.060, and 18
are eligible for compensation under RCW 43.03.250.19
(5) The council shall meet as often as necessary at the call of 20
the chair or by vote of the council, but not less than quarterly. A 21
majority vote of the members of the council is required for any vote 22
or official action by the council. 23
(6) The council shall direct the administrator to prepare and 24
present for approval a plan of operations related to the operations, 25
management, and administration of the fund on an annual basis. At 26
least annually, the council shall direct the administrator to present 27
the plan of operations to the appropriate policy committees of the 28
legislature. The plan shall include, but not be limited to, reporting 29
on the fund assets, projections for the durability of the fund, the 30
success of the fund, and whether or not the fund is serving its 31
purpose. 32
(7) The department shall provide secretarial and administrative 33
services for the council and shall serve as custodian of the records.34
NEW SECTION. Sec. 4. (1) There is established a fund for the 35
purposes of reimbursing eligible claims paid by electrical companies 36
and consumer-owned utilities for damages that resulted from a covered 37
wildfire. Electrical companies must participate in the fund and pay 38
the fund contribution set by the council under section 3 (1)(c) of 39

this act. Consumer-owned utilities may elect to participate in the 1
fund. All electric utilities participating in the fund must comply 2
with the requirements of this section to maintain eligibility for 3
disbursements from the fund. 4
(2) To maintain eligibility for the fund, a participating 5
electric utility must: 6
(a) Remit to the administrator of the wildfire fund an annual 7
contribution set by the council. A participating electric utility may 8
collect a surcharge from its customers to cover the cost of the 9
wildfire fund annual contribution in the form of a cost recovery 10
rider, provided that it provides a discounted rate to low-income 11
customers consistent with RCW 80.28.068; 12
(b) Comply with the utility's submitted and approved wildfire 13
mitigation plan. Submission and approval of an electrical company's 14
wildfire mitigation plan shall be consistent with RCW 80.28.445. For 15
consumer-owned utilities, wildfire mitigation plans created 16
consistent with RCW 19.29A.170 must be submitted to the council for 17
approval; and 18
(c) Maintain commercially reasonable wildfire insurance coverage.19
(3) The council shall annually review and set the:20
(a) Wildfire surcharge for each participating electric utility. 21
The council may set the surcharge for participating consumer-owned 22
utilities at a lower rate than electrical companies. In setting the 23
surcharge, the council must consider the: 24
(i) Balance of the fund and a fund reserve level sufficient to 25
support: 26
(A) The expected liabilities of the fund over the current and 27
next fiscal biennium; and 28
(B) The administration of the fund; 29
(ii) Market share of each participating electric utility; and30
(iii) Number of customers and high risk customers of each 31
participating utility; 32
(b) Damages threshold for fund eligibility for each participating 33
electric utility, based on the number of high risk customers the 34
utility serves and the miles of transmission lines the utility owns 35
and operates. The damages threshold shall be the amount of damages 36
from a covered wildfire for which each participating electric utility 37
is responsible before it can seek reimbursement from the fund. Once 38
the damages for a covered wildfire surpass this amount, the 39

participating electric utility can seek reimbursement from the 1
administrator for excess liabilities that surpass the threshold.2
(4) To be eligible for payment under this section, a claim must:3
(a) Be made by an electric utility meeting the eligibility 4
requirements of this section; 5
(b) Be for third-party damages against the electric utility;6
(c) Result from a covered wildfire that occurred after July 1, 7
2021; and 8
(d) Exceed the electric utility's damages threshold.9
(5) The payment of a claim under this section is conditional on 10
the availability of specific funding for this purpose, and nothing in 11
this section shall be construed to create an entitlement to 12
reimbursement or payment of any claim. The total amount paid for 13
claims may not exceed the amounts available in the account 14
established in subsection (6) of this section. 15
(6)(a) The wildfire prevention and protection account is created 16
in the state treasury. All moneys received by the administrator from 17
participating electric utilities must be deposited into the account. 18
Expenditures from the account may be used only for payments of claims 19
to electric utilities pursuant to and for the administration of the 20
fund, including expenses incurred under sections 3, 5, and 13 of this 21
act. Only the administrator or the administrator's designee may 22
authorize expenditures from the account. The account is subject to 23
allotment procedures under chapter 43.88 RCW. An appropriation is 24
required for administrative expenses, but not for payments of claims.25
(b) Investment earnings received by the wildfire prevention and 26
protection account shall be transferred to the wildfire response, 27
forest restoration, and community resilience account in RCW 76.04.511 28
at least annually. 29
(c) On the last business day of June of each year, the state 30
treasurer, based upon information provided by the department, must 31
transfer from the wildfire prevention and protection account to the 32
wildfire response, forest restoration, and community resilience 33
account in RCW 76.04.511 a sum equal to the investment earnings 34
received by the wildfire prevention and protection account posted 35
during the current fiscal year. 36
(7) The council may adopt rules to implement this section. Any 37
rules adopted under this section must be made publicly available on 38
the website of the department. 39

NEW SECTION. Sec. 5. (1) The administrator shall carry out the 1
duties of the council in administering the fund and may, subject to 2
the approval of the council:3
(a) Retain, employ, or contract with officers, experts, 4
employees, accountants, actuaries, financial professionals, and other 5
executives, advisers, consultants, attorneys, and professionals as 6
may be necessary in the administrator's judgment for the efficient 7
operation and administration of the fund; 8
(b) Receive and deposit in the fund any remitted fund 9
contributions and wildfire fund annual contributions;10
(c) Enter into contracts and other obligations relating to the 11
operation, management, and administration of the fund;12
(d) Review and approve claims and provide funds to the 13
participating electric utilities for the purposes of paying eligible 14
claims, in accordance with section 4 of this act; 15
(e) Buy insurance or take other actions to maximize the claims 16
paying resources of the fund; 17
(f) Pay costs, expenses, and other obligations of the fund;18
(g) Take any actions necessary to collect any amounts owing to 19
the fund from participating electric utilities; 20
(h) Require repayment of any funds disbursed to an electric 21
utility for claims related to a covered wildfire for which the 22
utility acted with gross negligence, willfulness, or intentionality 23
as determined in a finding by a court of law after 24
a final disposition of the case has been reached; 25
(i) Undertake such other activities as are related to the 26
operation, management, and administration of the fund, as approved by 27
the council. 28
(2) The salary of the administrator shall be set by the council 29
in accordance with RCW 43.03.040. The administrator is a state 30
employee for purposes of chapter 42.52 RCW. 31
NEW SECTION. Sec. 6. (1) The state shall have no liability for 32
payment of claims in excess of funds available and any of the funds 33
of the state shall have no obligations whatsoever for payment of 34
claims or costs arising from this chapter.35
(2) The council is not liable for the implementation of a 36
wildfire mitigation plan by an electric utility. There is no 37
liability on the part of, and no cause of action of any nature may 38
arise against, the state, council, council members, council staff, or 39

council representatives, agents, or consultants for the death of or 1
injury to persons, or property damage, for any action taken by them 2
in the performance of their powers and duties exercised under this 3
chapter. 4
Sec. 7. RCW 43.84.092 and 2025 c 417 s 802, 2025 c 399 s 15, 5
2025 c 359 s 12, and 2025 c 299 s 21 are each reenacted and amended 6
to read as follows: 7
(1) All earnings of investments of surplus balances in the state 8
treasury shall be deposited to the treasury income account, which 9
account is hereby established in the state treasury.10
(2) The treasury income account shall be utilized to pay or 11
receive funds associated with federal programs as required by the 12
federal cash management improvement act of 1990. The treasury income 13
account is subject in all respects to chapter 43.88 RCW, but no 14
appropriation is required for refunds or allocations of interest 15
earnings required by the cash management improvement act. Refunds of 16
interest to the federal treasury required under the cash management 17
improvement act fall under RCW 43.88.180 and shall not require 18
appropriation. The office of financial management shall determine the 19
amounts due to or from the federal government pursuant to the cash 20
management improvement act. The office of financial management may 21
direct transfers of funds between accounts as deemed necessary to 22
implement the provisions of the cash management improvement act, and 23
this subsection. Refunds or allocations shall occur prior to the 24
distributions of earnings set forth in subsection (4) of this 25
section. 26
(3) Except for the provisions of RCW 43.84.160, the treasury 27
income account may be utilized for the payment of purchased banking 28
services on behalf of treasury funds including, but not limited to, 29
depository, safekeeping, and disbursement functions for the state 30
treasury and affected state agencies. The treasury income account is 31
subject in all respects to chapter 43.88 RCW, but no appropriation is 32
required for payments to financial institutions. Payments shall occur 33
prior to distribution of earnings set forth in subsection (4) of this 34
section. 35
(4) Monthly, the state treasurer shall distribute the earnings 36
credited to the treasury income account. The state treasurer shall 37
credit the general fund with all the earnings credited to the 38
treasury income account except: 39

(a) The following accounts and funds shall receive their 1
proportionate share of earnings based upon each account's and fund's 2
average daily balance for the period: The abandoned recreational 3
vehicle disposal account, the aeronautics account, the Alaskan Way 4
viaduct replacement project account, the ambulance transport fund, 5
the budget stabilization account, the capital vessel replacement 6
account, the capitol building construction account, the Central 7
Washington University capital projects account, the charitable, 8
educational, penal and reformatory institutions account, the Chehalis 9
basin account, the Chehalis basin taxable account, the clean fuels 10

Washington University capital projects account, the wildfire 24
prevention and protection account, the Yakima integrated plan 25
implementation account, the Yakima integrated plan implementation 26
revenue recovery account, and the Yakima integrated plan 27
implementation taxable bond account. Earnings derived from investing 28
balances of the agricultural permanent fund, the normal school 29
permanent fund, the permanent common school fund, the scientific 30
permanent fund, and the state university permanent fund shall be 31
allocated to their respective beneficiary accounts.32
(b) Any state agency that has independent authority over accounts 33
or funds not statutorily required to be held in the state treasury 34
that deposits funds into a fund or account in the state treasury 35
pursuant to an agreement with the office of the state treasurer shall 36
receive its proportionate share of earnings based upon each account's 37
or fund's average daily balance for the period. 38

(5) In conformance with Article II, section 37 of the state 1
Constitution, no treasury accounts or funds shall be allocated 2
earnings without the specific affirmative directive of this section.3
Sec. 8. RCW 43.84.092 and 2025 c 417 s 802, 2025 c 399 s 15, and 4
2025 c 299 s 21 are each reenacted and amended to read as follows:5

(b) Any state agency that has independent authority over accounts 31
or funds not statutorily required to be held in the state treasury 32
that deposits funds into a fund or account in the state treasury 33
pursuant to an agreement with the office of the state treasurer shall 34
receive its proportionate share of earnings based upon each account's 35
or fund's average daily balance for the period. 36
(5) In conformance with Article II, section 37 of the state 37
Constitution, no treasury accounts or funds shall be allocated 38
earnings without the specific affirmative directive of this section.39

treasury and affected state agencies. The treasury income account is 21
subject in all respects to chapter 43.88 RCW, but no appropriation is 22
required for payments to financial institutions. Payments shall occur 23
prior to distribution of earnings set forth in subsection (4) of this 24
section. 25
(4) Monthly, the state treasurer shall distribute the earnings 26
credited to the treasury income account. The state treasurer shall 27
credit the general fund with all the earnings credited to the 28
treasury income account except: 29
(a) The following accounts and funds shall receive their 30
proportionate share of earnings based upon each account's and fund's 31
average daily balance for the period: The abandoned recreational 32

revenue recovery account, and the Yakima integrated plan 17
implementation taxable bond account. Earnings derived from investing 18
balances of the agricultural permanent fund, the normal school 19
permanent fund, the permanent common school fund, the scientific 20
permanent fund, and the state university permanent fund shall be 21
allocated to their respective beneficiary accounts.22
(b) Any state agency that has independent authority over accounts 23
or funds not statutorily required to be held in the state treasury 24
that deposits funds into a fund or account in the state treasury 25
pursuant to an agreement with the office of the state treasurer shall 26
receive its proportionate share of earnings based upon each account's 27
or fund's average daily balance for the period. 28
(5) In conformance with Article II, section 37 of the state 29
Constitution, no treasury accounts or funds shall be allocated 30
earnings without the specific affirmative directive of this section.31
Sec. 12. RCW 43.84.092 and 2025 c 417 s 803, 2025 c 399 s 16, 32
2025 c 299 s 22, and 2025 c 228 s 15 are each reenacted and amended 33
to read as follows: 34
(1) All earnings of investments of surplus balances in the state 35
treasury shall be deposited to the treasury income account, which 36
account is hereby established in the state treasury.37
(2) The treasury income account shall be utilized to pay or 38
receive funds associated with federal programs as required by the 39

federal cash management improvement act of 1990. The treasury income 1
account is subject in all respects to chapter 43.88 RCW, but no 2
appropriation is required for refunds or allocations of interest 3
earnings required by the cash management improvement act. Refunds of 4
interest to the federal treasury required under the cash management 5
improvement act fall under RCW 43.88.180 and shall not require 6
appropriation. The office of financial management shall determine the 7
amounts due to or from the federal government pursuant to the cash 8
management improvement act. The office of financial management may 9
direct transfers of funds between accounts as deemed necessary to 10
implement the provisions of the cash management improvement act, and 11
this subsection. Refunds or allocations shall occur prior to the 12
distributions of earnings set forth in subsection (4) of this 13
section. 14
(3) Except for the provisions of RCW 43.84.160, the treasury 15
income account may be utilized for the payment of purchased banking 16
services on behalf of treasury funds including, but not limited to, 17
depository, safekeeping, and disbursement functions for the state 18
treasury and affected state agencies. The treasury income account is 19
subject in all respects to chapter 43.88 RCW, but no appropriation is 20

Sec. 13. RCW 76.04.185 and 2023 c 132 s 2 are each amended to 29
read as follows: 30
(1) The department, in consultation with the energy resilience 31
and emergency management office of the department of commerce, shall 32
contract with an independent consultant with experience in developing 33
electric utility wildfire mitigation plans to develop an electric 34
utility wildfire mitigation plan format and a list of elements to be 35
included in electric utility wildfire mitigation plans. When 36
developing the plan format and list of elements, the department shall 37
seek input from the utilities and transportation commission, the 38
utility wildland fire prevention advisory committee, electric 39

utilities, the state fire marshal, the governor's office of Indian 1
affairs, and the public. By April 1, 2024, the department shall make 2
public a recommended format and list of elements for electric utility 3
wildfire mitigation plans. The department may update these guidelines 4
annually if needed, but not more than once in each year.5
(2) The recommended elements must acknowledge that utilities 6
serve areas that vary in topography, vegetation, population, and 7
other characteristics, and that best practices guidelines within each 8
element must recognize that a utility's wildfire mitigation measures 9
will be designed to fit site-specific circumstances. The recommended 10
elements must include, but are not limited to: 11
(a) Vegetation management along transmission and distribution 12
lines and near associated equipment; 13
(b) Infrastructure inspection and maintenance repair activities, 14
schedules, and recordkeeping; 15
(c) Modifications or upgrades to facilities and construction of 16
new facilities to incorporate cost-effective measures to minimize 17
fire risk; 18
(d) Preventative programs, including adoption of new technologies 19
to harden utility infrastructure; 20
(e) Operational procedures; 21
(f) Identification of appropriate widths for vegetation 22
management and rights-of-way, including the consideration of fire-23
resistant vegetation alternatives; ((and))24
(g) Public and interested parties' engagement and communication 25
plans addressing wildfire safety and risk mitigation; and26
(h) After January 1, 2027, recommendations included in the report 27
submitted by the work group established in section 1, chapter 324, 28
Laws of 2025. 29
(3) The recommended format and list of elements identified by the 30
department must be forwarded to the utilities and transportation 31
commission, the energy resilience and emergency management office of 32
the department of commerce, and all electric utilities in Washington 33
state for a review period of no less than three months prior to 34
finalizing the format and list of elements that utilities will use to 35
adopt or update their electric utility wildfire mitigation plan.36
(4) The department will provide technical assistance to all 37
electric utilities to support inclusion of these guidelines in the 38
revision of their plans. 39

(5) By December 31, 2024, the department must submit to the 1
appropriate committees of the senate and house of representatives a 2
compilation and summary of existing wildfire mitigation plans 3
maintained by electric utilities. 4
(6) The definitions in this subsection apply throughout this 5
section unless the context clearly requires otherwise.6
(a) "Consumer-owned utility" means a municipal electric utility 7
formed under Title 35 RCW, a public utility district formed under 8
Title 54 RCW, an irrigation district formed under chapter 87.03 RCW, 9
a cooperative formed under chapter 23.86 RCW, or a mutual corporation 10
or association formed under chapter 24.06 RCW, that is engaged in the 11
business of distributing electricity to more than one retail electric 12
customer in the state. 13
(b) "Electric utility" means a consumer-owned utility or an 14
investor-owned utility as defined in this section.15
(c) "Investor-owned utility" means a corporation owned by 16
investors that meets the definition of "corporation" as defined in 17
RCW 80.04.010 and is engaged in distributing electricity to more than 18
one retail electric customer in the state. 19
Sec. 14. RCW 80.28.445 and 2025 c 156 s 2 are each amended to 20
read as follows: 21
(1)(a) Each electrical company must file a wildfire mitigation 22
plan with the commission as soon as practicable after July 27, 2025, 23
unless the company has previously filed a wildfire mitigation plan 24
with the commission prior to July 27, 2025. An electrical company 25
that has previously filed a wildfire plan with the commission must 26
file a plan update as soon as practicable after July 27, 2025. To the 27
extent practicable, a company should try to align the timing of 28
filing a plan and plan updates with the filing of a multiyear rate 29
plan under RCW 80.28.425. The company shall update a plan no less 30
frequently than every three years. The company shall provide a copy 31
of its wildfire mitigation plan and updates to the department of 32
natural resources and the utility wildland fire prevention advisory 33
committee created in RCW 76.04.780 in the format prescribed under RCW 34
76.04.185 to be posted on the committee's website. After January 1, 35
2027, all wildfire mitigation plans filed with the commission shall 36
consider the recommendations included in the report submitted by the 37
work group established in section 1, chapter 324, Laws of 2025.38

(b) Nothing in this subsection prohibits an electrical company 1
from updating its wildfire mitigation plan more often than required 2
under subsection (1)(a) of this section. 3
(2) The commission, after holding at least one public workshop 4
and a hearing, must by order approve, reject, or approve with 5
conditions, an electrical company's wildfire mitigation plan within 6
120 days or plan update within 90 days of the filing of such plan or 7
plan update. The commission may, in its order, recommend or require 8
additional elements or practices to be included in the company's 9
plan. The commission may, in approving with conditions the plan or 10
plan update, make modifications to the plan or plan update that the 11
commission reasonably finds represent a reasonable balancing of 12
mitigation costs with the resulting reduction of wildfire risk. The 13
commission shall issue an order explaining any modifications at the 14
time the plan or plan update is approved. In evaluating a plan or 15
plan update, the commission may consult with and consider information 16
from federal, tribal, state, or local governmental entities, 17
utilities, industry organizations, and groups representing utility 18
customers. The commission shall describe the nature of its 19
consultations with third parties in its order approving or approving 20
with conditions a plan or plan update. 21
(3) The commission must adopt rules to implement this section. 22
The rules must: 23
(a) Provide that a workshop be held pursuant to subsection (2) of 24
this section that will involve local fire protection districts, 25
utilities, affected landowners, and groups representing utility 26
customers; and 27
(b) Include, but need not be limited to, procedures and standards 28
regarding vegetation management, including guidelines for determining 29
fair market landowner compensation when appropriate, public safety 30
power shutoffs and service restoration, pole materials, circuitry, 31
and monitoring systems. 32
(4) The commission is not liable for an electrical company's 33
implementation of its wildfire mitigation plan. There is no liability 34
on the part of, and no cause of action of any nature may arise 35
against, the state, commission, commissioners, commission staff, or 36
commission representatives, agents, or consultants for the death of 37
or injury to persons, or property damage, for any action taken by 38
them in the performance of their powers and duties exercised under 39
this section. 40

NEW SECTION. Sec. 15. Sections 1 through 6 of this act 1
constitute a new chapter in Title 76 RCW.2
NEW SECTION. Sec. 16. (1) Section 7 of this act expires the 3
earlier of July 1, 2028, or when RCW 74.76.040 expires.4
(2) Section 8 of this act expires July 1, 2028.5
(3) Section 9 of this act expires the earlier of January 1, 2029, 6
or when RCW 74.76.040 expires. 7
(4) Section 10 of this act expires January 1, 2029.8
(5) Section 11 of this act expires when RCW 74.76.040 expires.9
NEW SECTION. Sec. 17. (1) Section 8 of this act takes effect 10
when RCW 74.76.040 expires.11
(2) Sections 9 and 10 of this act take effect July 1, 2028.12
(3) Sections 11 and 12 of this act take effect January 1, 2029.13
